Class Councils of Brazil annuity

The government begins to discuss the end of the obligation to pay annuity for professionals who are part of existing professional class councils in Brazil, they understand that this charge is similar to the union tax, therefore, illegal

A legislative proposal to extinguish the annuity payment of all professional class councils, was presented in the Senate on January 26, 2019 and endorsed today (06) by Federal Deputy Joice Joice Hasselmann on social networks. Citing a few examples: the Brazilian Bar Association (OAB) and class councils, such as the Regional Engineering and Agronomy Council (Crea) and the Architecture and Urbanism Council (CAU), among many others, we will list them all at the end of the article.

According to the project, the annual payment is similar to how the union tax was collected, and which ended up being extinguished in the last Labor Reform.

There are many complaints from Brazilians who are prevented from working in their areas because they cannot pay the high fees

“The obligation to pay the annuity of regulatory bodies such as CREA, CAU, OAB, among others, only burdens the professional and does not add anything to the development of the class. The idea is that the payment of only the annuity is optional, not extending to other types of services such as collecting ART, in the case of an engineer”, via publication on the Senate website and which is open to voting by all professionals from these councils.( ⇐ Log in if you want to vote for or against)

Making an analogy with DETRAN, which issues a license to drive or pilot vehicles, regardless of whether the citizen has practical skills or not, class councils work the same way. It is considered qualified to exercise a specific profession when it proves completion of a course recognized by the MEC duly registered. Another important attribution of the class councils is the role of supervising the activities inherent to the professional's area of activity, for example: Inspection of a work, verifying that it was carried out by a qualified professional and that ethical regulations are being followed.
