A handwritten document from 1998, attributed to Gianni Agnelli, was presented by lawyers for Margherita Agnelli during a hearing at the Turin Court on Monday, September 29, 2025. The text suggests that 25% of the holding Dicembre should go to son Edoardo Agnelli. Edoardo died in 2000. The share ended up in the hands of grandson John Elkann based on a prior document from 1996. The information was reported by Reuters, which claims to have seen the note.

The Italian agency ANSA reported that the alleged new will was filed in Turin and explicitly mentions the transfer of the share of the “Dicembre vault” to Edoardo, reinforcing the potential conflict with previous arrangements.

The case is part of a long-standing dispute between Margherita and the children of the first marriage—John, Lapo, and Ginevra Elkann—over the division and governance of the group. Reuters reports that Elkann’s defense considers the new document irrelevant in light of a 2004 agreement that, according to them, ended the redistribution of the inheritance and formalized Margherita’s exit from Dicembre.

The combined wealth of the clan is estimated at US$ 14.2 billion, according to the Bloomberg Billionaires Index. The size of the fortune helps explain the intensity of the dispute and public scrutiny.

Why Dicembre and Exor Matter in the Agnelli Inheritance Case

Dicembre is the holding company that anchors the Agnelli branch’s power within Exor, an investment company that holds strategic stakes. The control of Exor supports influence over Ferrari and Stellantis, pillars of the business empire. If the 1998 document stands, the power arrangement may be questioned.

In 2003, after Gianni’s death, widow Marella Caracciolo allegedly followed the 1996 writing to transfer the 25% share to John Elkann, consolidating a line of succession that shaped the group’s decisions over the past two decades. Bloomberg notes that this move secured Elkann a central position in the family command.

In practice, any change in ownership of that 25% impacts the chain of control. Even without altering stakes in the open market, a court decision that reinterprets Gianni’s will may force corporate rearrangements and open collateral litigation fronts.

For investors in Ferrari and Stellantis, the risk is less operational and more about governance: uncertainty regarding voting in boards, long-term strategy, and potential shareholder agreements. History suggests the family seeks to maintain stability, but a window of unpredictability exists while the process unfolds.

What Each Side Says in the Case

Margherita Agnelli maintains that the 1998 manuscript better expresses Gianni’s final will by dedicating the share of Dicembre to Edoardo. Since Edoardo died in 2000, the legal interpretation regarding substitution of heir and effects on subsequent agreements becomes the central point of debate.

The defense of John Elkann argues that a 2004 agreement finalized the division and that the new document does not change what has already been implemented, including Margherita’s exit from Dicembre. Meanwhile, Elkann continues to hold the positions of chairman of Ferrari and Stellantis and leader at Exor.

There are also related investigations with allegations about assets and artworks linked to the estate, reported by the British press, illustrating the degree of friction between the family branches and expanding the context of the litigation.

In legal terms, experts emphasize that the weight of the manuscript will depend on formal validity, chronology, and how it interacts with prior succession instruments and approved agreements. The case continues in Italian court, with potential transnational implications given the structure of the assets.

Possible Impacts on Ferrari and Stellantis

In the short term, operations and production will not change. The focus is on governance: who decides strategy, appointments, and capital allocation. A decision that reshapes the command chain may alter board dynamics and the pace of investments.

Ferrari, with its high margin focus and global brand, is sensitive to stability narratives. Meanwhile, Stellantis, the automotive conglomerate, relies on long-term decisions regarding electrification, software, and factory allocations. Changes in the control structure may influence risk appetite and the timing of these bets.

For the market, what matters is the perception of continuity. If the court validates the manuscript, the family may seek an internal solution that preserves strategic control, reducing noise. Otherwise, the dispute is likely to prolong, with primarily reputational impacts.

Investors should monitor Exor statements and potential motions in meetings. Formal movements are the channel where private litigation becomes a relevant corporate fact.

Tax Agreement and Investigations

On September 8, 2025, John Elkann and his brothers agreed to one year of community service and the joint payment of € 183 million to settle a tax dispute related to the estate of Marella Caracciolo. The arrangement does not imply admission of guilt within the Italian system but concludes the criminal case.

The tax dispute had included searches and seizures and asset seizure measures months earlier as part of the contentious environment surrounding inheritances and the Dicembre holding. This backdrop helps explain why any new document holds explosive potential.

In addition, parallel allegations about artworks from the family collection have emerged, still under investigation by Italian authorities, adding complexity to the case.
