Workers Exposed to Unhealthy or Dangerous Conditions Can Ensure an Early Benefit with the New INSS Rule. Find Out if You Are Entitled and How Special Retirement Works!

Good news for those who contribute to the INSS! If you have worked with a formal contract for 15, 20, or 25 years and are in a profession considered risky or unhealthy, you can retire earlier at 55 years old through Special Retirement. This mode ensures that workers exposed to harmful conditions have the right to an early benefit. But how does this new government rule work? Which professions are included? We will explain everything about the new INSS law and how it can help you achieve special retirement.

What Is the Special Retirement of the INSS?

Special Retirement is a benefit offered by the INSS for workers engaged in activities that put health or physical integrity at risk. With the new INSS law, approved in 2019, it was established that these professionals can retire at 55 years old, provided they have contributed for 15, 20, or 25 years, depending on the profession. This type of retirement has several advantages:

  • Does not require a minimum age for those who were already in the market before the 2019 reform;
  • Ensures a more advantageous calculation of the benefit, without applying the previdential factor;
  • Has a transition rule for those who were already contributing before the reform.

Which Professions Are Entitled to Special Retirement?

The list of professions that fall under the new INSS law is extensive. These activities are considered unhealthy or risky, ensuring the possibility of early retirement. Check out some of the main ones:

  • Aviation Ground Services
  • Nursing Assistant
  • Firefighter
  • Electrician with exposure above 250 volts
  • Chemical, Metallurgical, and Mining Engineers
  • Bus and Truck Driver (over 4,000 tons)
  • X-Ray Operator
  • Fisherman
  • Welder
  • Armed Guard

These and other professions are detailed on the INSS website, and it is essential to check if your activity qualifies before requesting the benefit.

How to Request Special Retirement?

The process for requesting Special Retirement from the INSS can be done in person or online. See how to proceed in each case:

1. Through the Meu INSS Website or App

  • Access the Meu INSS website or download the app;
  • Log in using your Gov.br account;
  • Click on “New Request” and type “retirement”;
  • Select the Special Retirement option;
  • Fill in the necessary information and attach the required documents;
  • Submit the request and await analysis.

2. In Person at INSS Agencies

  • Schedule the appointment by phone 135 or through the website;
  • Attend the agency on the scheduled date and time with the documents in hand;
  • Fill out the application form and complete the request.

3. By Phone 135

If you prefer, you can also make the request quickly and easily by phone. Just call 135 (available Monday to Saturday, from 7 am to 10 pm) and formalize your request.

Documents Needed to Request Retirement

Regardless of how you choose to request the government benefit, some documents are essential:

  • ID and CPF
  • Birth or marriage certificate
  • Work card
  • Contribution statement (CNIS)
  • Proof of residence
  • Documents proving exposure to unhealthy or dangerous conditions (PPRA, LTCAT, PPP)

These documents help prove the contribution time and the unhealthy activity, facilitating the analysis of your request by the INSS.

Why Is the New INSS Law Important?

The new INSS law brought considerable changes for Brazilian workers. Previously, special retirement depended on less clear rules, and many professionals faced difficulties in obtaining the government benefit. With the reform, the government established more defined criteria, ensuring that workers in unhealthy conditions have the right to early retirement.

Moreover, the use of technology by the INSS, such as the Meu INSS app, made access to the benefit easier, allowing citizens to track their requests simply and quickly.

What Changes for Those Who Entered the Market After 2019?

Those who started contributing to the INSS after the 2019 pension reform can also request special retirement but must meet some different criteria:

  • Contribution time: Special retirement still requires 15, 20, or 25 years of contribution, depending on the activity;
  • Minimum age: The new rule establishes a minimum age of 55 years for workers in unhealthy conditions.

These changes help ensure that the benefit continues to be a form of protection for those who work in risky activities. Special Retirement is an important right for workers who engage in high-risk conditions. With the new INSS law, the government ensures that these professionals can retire earlier and with a fair benefit. If you meet the criteria, don’t waste time and request your benefit.

Keep an eye on deadlines, organize your documents, and take advantage of the digital tools available to facilitate the process. Your future starts now, and the INSS is ready to help you secure your retirement with peace of mind.
