The amount received still underwent mandatory deductions. In the United States, lottery prizes are subject to federal and state taxes.

Thus, from the 1.25 million dollars, 24% in federal tax, equivalent to 300 thousand dollars, and an additional 4% in state tax, about 50 thousand dollars, were deducted.

In the end, Kelly took home around 900 thousand dollars net.

The individual story also reflects on the collective. According to Virginia Governor Glenn Youngkin, the lottery raised 934 million dollars in the last fiscal year, a figure that represents 10% of the state budget allocated to basic education.

The case that drew attention from Brazil and the world in 2023 has come back into the spotlight. Antônio Pereira do Nascimento, a 59-year-old self-employed driver from Palmas (TO), is seeking a million-dollar compensation from the bank responsible for mistakenly transferring over R$ 131 million to his account.

In addition to seeking compensation for moral damages, he is claiming 10% of the returned amount, supporting his demand with articles from the Civil Code.

The Banking Error That Generated National And International Repercussions

The episode occurred in June 2023. Antônio had sold a property and, after the negotiation, deposited the amount received into his personal account.

He then went to the bank branch to transfer this money to another financial institution, also in an account under his name.

When conducting the procedure at the physical counter, everything seemed normal. He left the bank with the operation receipt and only realized something was wrong when checking the app at home.

The balance showed the absurd amount of R$ 131,870,227, far exceeding his reality.

The Immediate Return And The Pressure Suffered

Frightened by the amount, Antônio first sought contact with the manager of the second bank, responsible for receiving the transfer.

Next, he informed the employee of the institution who had performed the operation about the error.

However, according to the lawsuit, the response was not calm. He claims to have suffered psychological pressure and even threats, such as the allegation that there were people in front of his residence waiting for the return.

Even outside banking hours, the driver managed to reverse the operation. With the help of the manager at the second institution, the return was completed the same day.

The Judicial Action And Antônio’s Requests

After the scare and extensive exposure, Antônio filed a lawsuit in the 6th Civil Court of Palmas. He is asking for R$ 150 thousand in compensation for moral damages, alleging emotional distress, embarrassment, and direct impacts on his personal life.

Additionally, he is requesting 10% of the returned amount as a form of legal reward, totaling R$ 13,187,022.

The defense argues that the client was treated as a criminal, even though he acted correctly and reported the error immediately.

Account Change By The Bank And Embarrassments

Another point raised in the lawsuit concerns the changes imposed by the bank itself. According to Antônio, the checking account was unilaterally reclassified to the “Select” category, increasing fees and causing financial inconveniences.

He also points out that the case’s repercussion generated enormous media exposure, both nationally and internationally. For a simple and reserved person, the psychological impact would have been even stronger.

What The Law Says About Similar Cases

Brazilian legislation provides for similar situations. Article 1.233 of the Civil Code addresses the so-called “discovery,” determining that anyone who finds property or value belonging to another person must return it or turn it over to authorities.

Article 1.234 ensures that anyone returning something found is entitled to a reward. This compensation should not be less than 5% of the returned value, in addition to covering any expenses related to custody and transportation.

Defense Arguments And The Driver’s Allegations

Antônio’s lawyers argue that the bank could not reverse the amount on its own since the money had been transferred to an account at another institution.

The return could only occur through judicial or administrative action with the Central Bank.

They emphasize that, on his own initiative, the driver ensured the return, demonstrating honesty. However, he was treated disrespectfully and coerced by representatives of the institution.

For the defense, the episode caused fear and trauma to the client, who began to fear for his own safety and that of his family.

Next Steps And Expectation Of The Verdict

The process is ongoing and is under review by the 6th Civil Court of Palmas. There is no judicial decision yet, but the discussion promises to set an important precedent regarding rewards in cases of returning large sums.

Antônio’s story shows that even when acting correctly, citizens can face difficulties in the face of banking errors.

The outcome of the case will be closely monitored, as it involves not just a million-dollar amount but also the interpretation of rights stipulated by law.
