The national holiday on November 15 celebrates the Proclamation of the Republic since 1889.
The date falls on a Saturday in 2025.
This raises questions among workers, companies, and essential services.
The rules regarding time off, compensation, and double payment remain valid.
These rules follow Law No. 10,607/2002.
They also follow Law 605/1949.
They also adhere to Summary No. 146 of the Superior Labor Court (TST).

What the Holiday of November 15 Represents

November 15 is a civil holiday listed by Law No. 10,607/2002.
The Federal Senate published this law on December 19, 2002.
It is part of the national calendar every year.

The date marks the Proclamation of the Republic that occurred on November 15, 1889.
Marshal Deodoro da Fonseca led the movement that ended the monarchy.
The Ministry of Education emphasizes the historical importance of this date.

However, the date is fixed and can generate questions when it falls on the weekend.
This occurs in 2025, when it will be celebrated on a Saturday.

Who Has the Right to Time Off on the Holiday

Although it falls on a Saturday, the holiday is valid throughout the national territory.
The labor rules follow the norms of the Ministry of Labor and Employment.
They also follow the guidelines from the TST.

The right to rest depends on the weekly work schedule of the worker.
This changes the way compensation is handled.

  • Workers from Monday to Friday do not experience practical changes.
  • Rest already occurs on Saturdays.
  • There is no additional compensation.
  • Workers who work on Saturdays are entitled to double pay.
  • They may receive a compensatory day off.
  • This follows Art. 9 of Law 605/1949.
  • This also follows Summary No. 146 of the TST.
  • Essential sectors can operate normally.
  • Hospitals, public transportation, and security operate on specific shifts.
  • The employer must ensure subsequent compensation.
  • This requirement is in the guidelines from the Ministry of Labor for 2024.

Moreover, banks, schools, and public offices do not operate on this holiday.
This follows the guidelines from Febraban and state secretariats.

Does a Holiday on the Weekend Change the Payment?

Payment depends on the weekly work schedule of the worker.

When there is work on Saturday and work on the holiday, the payment is doubled.
It can be replaced by a compensatory day off.
This rule does not depend on the year.
It has remained valid since the publication of Law 605/1949.

Therefore, only those who work on Saturday are entitled to differentiated payment.
Those who work from Monday to Friday already rest regardless of the date.

And When the Holiday Falls on a Sunday?

The logic remains the same.

Those who already rest on Sundays do not receive compensation.
Those who work on that day receive double payment or time off.
This interpretation is upheld by the TST.
It was reaffirmed in decisions from 2022, 2023, and 2024.

Thus, even with clear legislation, questions continue to arise when a holiday falls on the weekend.
This reinforces the importance of adequate legal guidance.
