How the Case Reached the Court
Initially, the first-instance decision had acquitted the accused. However, the Public Ministry of the Federal District appealed, arguing that the evidence demonstrated discriminatory connotation in the insults, which would characterize the crime of homophobic insult.

The defendant was sentenced to two years and four months of imprisonment in an open regime, with the sentence replaced by two restrictions of rights, in addition to 12 days-fine at the minimum amount.
It was also established the payment of R$ 500 as compensation for moral damages to the victim.
According to Conjur, the decision was unanimous and serves as a warning that the workplace must be protected against discriminatory practices, requiring the justice system to act firmly in cases of homophobic insults.
