According to the MPF, three of his assistants and three former executives of the Odebrecht group are also involved in the complaint. The indictment contains ten undue payments totaling R$ 1,440 million as a counterpart for the Municipality not to create embarrassments for the public-private partnership with Odebrecht Ambiental in the mandate started in 2013.

The investigation by the MPF in the 2nd Region (RJ/ES) was based on corroboration and revelations by executives from the Odebrecht group who were accomplices in the scheme and who became collaborators with Justice – including the former president of Odebrecht Ambiental who authorized the undue payments. In addition to the mayor, the MPF denounced Jean Vieira de Lima (municipal attorney), Marcos André Riscado de Brito (former Controller in Macaé), Welton Carlos Arantes Vasconi (intermediary for Dr. Aluízio) and three former Odebrecht executives: Fernando Luiz Ayres da Cunha Santos Reis (former president of Odebrecht Ambiental), Renato Amaury de Medeiros (former director of Odebrecht Ambiental) and Fernando Fernandes Meias Bessa (former director of Odebrecht Ambiental/Macaé).

The TRF-2 authorized the breach of telematic secrecy and, with that, the MPF proved, for example, that one of the mayor's carriers attended the address scheduled for the delivery of R$ 270 thousand in June 2014.

At the end of the mayor's term, the criminal action against the four accused will be sent to the Federal Court in Macaé, which will assess whether it receives the complaint, making them defendants and starting the process.

“The bribe payments to the mayor were closely related to the regular exercise of the contract, since, once terminated, due to several factors, among them the beginning of Operation Lava Jato in 2014, the company had to resort to the Judiciary to receive the amounts to which he is entitled due to the contract signed with the Municipality", said the regional attorney of the Republic Carlos Alberto Aguiar, member of the Criminal Nucleus for Combating Corruption (NCCC) of the MPF at the 2th Region.
