Have You Ever Wondered If It’s Possible to Run a Red Light in the Middle of the Night Without Being Fined? This Is a Myth That Persists on Brazilian Streets and Can Lead Drivers to Commit Serious Violations Without Knowing.

Article 208 of the Brazilian Traffic Code (CTB) is clear: running a red light is a serious traffic violation, valid at any time of day or night.

The penalty for those who violate this rule is a fine of R$ 293.47 and the loss of seven points on the National Driver’s License (CNH).

However, there are specific situations where this rule may vary, especially in certain municipalities that adopt different practices during the night.

Why Does the Myth of Running a Red Light at Night Persist?

The myth that it is allowed to run a red light during the night has spread in such a way that many drivers believe they are exempt from penalties when committing this violation outside of business hours.

But the reality is quite different. According to the CTB, there are no exceptions that allow running a red light at night without suffering penalties.

The misconception may have arisen due to the adoption of municipal practices that, in some cases, choose to leave traffic lights in yellow blinking mode between 10 PM and 5 AM.

This does not mean it is allowed to run the red light, but rather that, at certain times, cities may opt for a different signaling system, allowing drivers to proceed with caution when the traffic light is blinking yellow.

What Does the Law Really Say?

As established by Article 24 of the CTB, municipalities are responsible for “implementing, maintaining, and operating the signaling system, devices, and road control equipment.”

This means that signaling can vary from city to city, creating some confusion for drivers who are not well acquainted with local legislation. However, the general rule remains: running a red light is a serious violation.

The only existing exception, which came into effect in April 2021, is Article 44-A of Law 14.071/2020. This change allows drivers to make a right turn at a red light, but only in places where there is specific signaling indicating that this maneuver is allowed.

This must be done with extreme caution, always prioritizing the safety of pedestrians and respecting local conditions.

The Importance of Local Signaling

Each city may have its own traffic rules, especially regarding signaling. Some cities choose to alter the operation of traffic lights during the night, but this should not be interpreted as permission to run a red light.

The presence of a blinking traffic light is a signal that requires heightened attention and caution from the driver, and not an authorization to disregard signaling.

Fines and Penalties

The fine for running a red light is one of the heaviest penalties provided for in the CTB. With a value of R$ 293.47 and the addition of seven points to the CNH, drivers who commit this violation can face serious problems, especially if they have already accumulated points on their license.

In addition, the violation is considered serious, which can result in the suspension of the right to drive in case of recurrence.

Traffic Safety

In addition to the fine, it is essential to consider the risks involved in running a red light. This practice can cause serious accidents, endangering the lives of pedestrians, other drivers, and the offender themselves.

In areas with high pedestrian traffic, such as schools, hospitals, and markets, the risk increases even more. Therefore, even if the signaling allows a right turn on red, this maneuver should be performed with caution.

Driver: Stay Alert to the Rules and Avoid Fines

The belief that it is possible to run a red light at night without consequences is a dangerous myth that can cost the driver dearly.

Knowing and following the rules of the CTB is essential to ensure traffic safety and avoid severe penalties. Therefore, do not fall into this trap: always respect the red light, regardless of the time, and stay alert to the specific signaling of each municipality.
