Federal Agency Investigates The Environmental Licensing Process Of The Enterprise

The Federal Public Ministry (MPF) has been investigating since April 2024 the construction of the São José Hydroelectric Power Plant in the municipality of Sapezal (MT). According to the MPF, there are indications that the work began in the second half of 2023 before the complete issuance of the environmental licenses required by current legislation. For this reason, Civil Inquiry No. 1.20.000.000204/2024-18 was instituted to verify the regularity of the environmental licensing and identify any flaws in the process. The investigation focuses on the compatibility of the enterprise with federal, state, and municipal environmental standards. The MPF’s goal is to ensure that the expansion of the energy sector in Mato Grosso occurs in accordance with regulatory benchmarks.

Technical Documents And Testimonies Support The Investigative Process

Since May 2024, the MPF has been analyzing documents presented by the company, environmental technical reports, and authorizing acts issued by the Secretariat of the Environment of Mato Grosso (SEMA-MT). In addition, the agency has heard representatives from SEMA-MT and environmental institutions involved in analyzing the project. The focus is to understand whether the environmental impact studies were carried out as required and whether there were any omissions or anticipations of licensing stages. The MPF is also investigating compliance with legal deadlines for conducting public hearings and prior consultation with local populations that may be impacted by the work. The investigation is ongoing, adhering to the principles of legality, transparency, and social participation.

Environmental Agencies Point Out Relevant Environmental Risks

Technicians from the Brazilian Institute of Environment and Renewable Natural Resources (IBAMA) identified that hydroelectric enterprises in sensitive areas can cause significant ecological and social changes. The São José Plant, which anticipates generating 42 megawatts, is located in a region influenced by the Juruena River, which requires careful analysis of cumulative impacts. Among the main points raised are the deforestation of permanent preservation areas, the interruption of ecological corridors, and the potential displacement of riverine communities. For this reason, the MPF evaluates whether all environmental conditions have been observed and whether the risks have been duly considered by the licensing agencies. The aim is to ensure that technical decisions are supported by consistent and legally established environmental criteria.

Preventive Action Seeks To Ensure Legality And Transparency In Energy Sector Works

The public prosecutor in charge of the case reiterated the importance of the preventive action of the Public Ministry in protecting socio-environmental rights. He stated that the investigation does not impose immediate penalties but ensures the correct application of legislation before the consolidation of the work. The action also aims to guide best practices in the private sector, especially in projects with significant potential environmental impact. Furthermore, the MPF emphasizes the importance of transparent processes, in which there is extensive disclosure of studies, public involvement, and respect for legal frameworks. The investigation follows technical and legal criteria with a focus on balancing economic development and environmental sustainability.

Process Remains Open And May Result In Corrective Measures

As of May 2025, the inquiry is still in the investigation phase and there is no definition on the deadline for its conclusion. However, the MPF may issue recommendations to the group responsible for the project or file a public civil action if irregularities are confirmed. The measures depend on the conclusion of technical analyses, the compatibility of the licensing with environmental laws, and the response from oversight agencies. The Public Ministry reaffirmed that it will conduct all stages based on technical evidence and following constitutional guidelines. It will inform society about the developments with transparency and responsibility, fulfilling its institutional duty to account for its actions.
