Many insured individuals who worked before 1994 do not know that this period can bring advantages in the calculation of retirement. Although the Federal Supreme Court has blocked the so-called “full life review,” it is still possible to use these old contributions to improve the value of the benefit.

According to lawyer Hilário Bocchi Junior, a specialist in Social Security Law, those who worked before 1994 can increase their salary average by discarding lower contributions made after this date.

The result is a higher retirement, as long as the correct planning is done.

How Retirement Calculation Works

The value of retirement is defined based on the so-called Basic Calculation Period (PBC), which considers all contributions made from July 1994 until the date of the benefit.

The salary average for this period is the starting point for calculating how much the insured will receive.

However, the law allows discarding lower salaries, as long as the insured has contribution time above the minimum required.

This is where the contributions made by those who worked before 1994 come into play: they can serve to complete the necessary time, making room to discard low salaries and increase the final average.

The Role of Contributions Made Before 1994

Although they do not directly enter the calculation, the contributions from those who worked before 1994 can be decisive in improving the retirement value.

They act as a sort of additional credit that allows for the discarding of months or years of lower remunerations within the PBC.

According to Hilário Bocchi Junior, each proven year before 1994 can mean the exclusion of one year of low salary after 1994, increasing the salary average. This explains why an insured individual with long contribution periods in the past may receive a significantly higher benefit.

Practical Examples of Strategic Discarding

Imagine a worker who completed the minimum contribution requirement of 15 years after 1994 but also had 3 years of contributions recorded before that date.

These 3 years allow him to discard 3 years of low salaries from the post-1994 period, calculating his retirement based only on the best salaries.

Hilário Bocchi Junior calls this practice “golden retirement”, as the intelligent use of time before 1994 can ensure that the insured retires with fewer years considered and a higher salary average.

Where It Is Worth Applying This Strategy

The rule can be applied in different modalities, such as retirement by age, hybrid retirement (urban + rural), special retirement, and even benefits for contribution time.

In all cases, the more contributions made before 1994 the worker can prove, the greater their chances of discarding low salaries and increasing the final value.

However, Hilário warns: “It is not enough to rely on the simulator of Meu INSS. Often, it ignores links, delayed contributions, or special periods.”

Therefore, individualized retirement planning is essential to verify whether it is worth recovering and proving old contributions.

Is It Worth Seeking Retirement Planning?

For the specialist, yes. Those who worked before 1994 and do not do planning run the risk of receiving a much lower amount than they actually could.

The detailed analysis allows for identifying whether it is worth recovering links, proving old periods, or even waiting a few more months to discard poor contributions.

According to Bocchi Junior, the ideal is for women to start this planning from the age of 53 and men from the age of 56, in order to organize documents, review links, and devise the best strategy to achieve maximum retirement value.

The so-called shallow calculation trap can harm thousands of insured individuals who do not recognize the importance of using contributions made before 1994.

Planning the discarding of low salaries is essential to increase the salary average and ensure a fair benefit.
