The MEI declaration has always been viewed as a simple and almost automatic obligation. An annual procedure, done in a few minutes, just to report the revenue of the previous year and keep the CNPJ regular.

That has changed. With a new rule in effect, the MEI declaration now has the character of a debt confession, allowing the Federal Revenue Service to expedite collections, send debts directly to Accounts Receivable, and apply harsher sanctions, often without the micro-entrepreneur realizing the risk they are taking.

What Changed in the MEI Declaration

The MEI declaration, officially called DASN SIMEI, remains mandatory and with the same filling format. The micro-entrepreneur reports annual revenue and sends the declaration within the legal deadline.

The change is not in the form, but in the legal effect. Now, when submitting the MEI declaration, the taxpayer officially acknowledges the taxes that have not been paid, turning the document into a valid debt confession instrument for immediate collection.

Before this rule, when the MEI had overdue DAS guides, the Revenue needed to open an administrative process to formalize the collection. This procedure took years until the amounts were entered into Accounts Receivable.

With the new rule, this path has been drastically shortened. From the MEI declaration, the Revenue can send debts directly to Accounts Receivable, without the need for an official declaration or long waiting periods.

What is Accounts Receivable and How Does It Affect the MEI

When the amounts from the MEI declaration that are unpaid are sent to Accounts Receivable, the debt ceases to be merely administrative and takes on significant legal weight.

At this moment, fines are automatically added, the name can be protested in a notary, included in default registries, and in official debtor records. The MEI’s CNPJ faces severe restrictions.

Real Risk for the Micro-entrepreneur’s CPF

A critical point is that the MEI does not have a separation between physical and legal person. This means that the debt generated from the MEI declaration can migrate from the CNPJ to the CPF.

In this scenario, the micro-entrepreneur can suffer tax enforcement, with account blockages, vehicle seizures, and even properties, if the debt is not regularized.

Collection by Multiple Agencies at the Same Time

Another aggravating factor is that the DAS guide gathers taxes of different natures. INSS, ISS, and ICMS belong to distinct government spheres.

When the amounts declared in the MEI declaration go to Accounts Receivable, the micro-entrepreneur can be charged simultaneously by federal, state, and municipal agencies, increasing the complexity and risk of the situation.

Why the Government Accelerated This Model

The new weight given to the MEI declaration is part of a stricter self-regulation model. The logic is simple: transfer to the taxpayer the responsibility to declare, acknowledge, and validate their debts.

In practice, this accelerates collection, reduces administrative steps, and increases the efficiency of collection, but puts the micro-entrepreneur in a much more vulnerable position.

What the MEI Needs to Do from Now On

In light of this change, the MEI declaration requires extra attention. It’s not enough just to declare. It is essential to keep the DAS guides up to date or seek regularization as soon as possible.

Ignoring debts or postponing payments now can lead to much faster and more severe consequences than in the past, including high fines and serious restrictions on business and personal life.

Regularization Became a Strategic Priority

For those who already have pending issues, regularizing the guides before or soon after the MEI declaration has become a strategic priority. Installments and negotiations are no longer just an option, but rather a necessity for asset protection.

The new rule does not prevent the MEI from declaring, but turns the declaration into a starting point for collection, rather than just a simple informative obligation.

Fico a imaginar, o cliente solicita para vc o ajude a ser MEI por que terá um benefício ou uma condição de trabalho com melhor rendimento, porém deixa de cumprir uma simples obrigação de recolher sua contribuição, DAS que no futuro o ajudara inclusive na aposentadoria. E quando formam uma divida ativa acham, a por que o governo e ****, a porte o Juruá está muito alta, a política impostos são severas. (Lembra quem deixou acumular) Eu mesmo o MEI, que achei um bom negócio ter esse benefício para ganhar melhor. Mas Sonego e quero mais renda.

Não vi a a ação como uma coisa ruim. Já mantenho minha contribuição em dia. Nossa atenção deve ser esta. Não deixar atrasar, porém se tiver em atraso é quitar até o último mês do exercício do ano letivo e depois declarar.

ou seja o pobre se Lascou de vez, agora graças as novas leis e cadastro de CPF pobres não vão conseguir alugar ou se sustentar,e o governo do roubando fora que essas multas se tiver algum erro vão ser milionária e sempre assim como no trânsito vão dar uma desculpa **** para dar multa,e não adianta aí vou mudar o presidente, esse dinheiro todo vai tudo pro bolso dos políticos, nenhum vai ser contra, só ver o valor das verbas para eleição ou a libertação dos presos, tão lixando para os pobres.
