Government Grants Free Energy Up to 80 kWh/Month for Those Who Fit Under the Social Electricity Tariff. Measure Came into Effect on July 5, 2025.

The Social Electricity Tariff (TSEE) has been reformatted by MP 1,300/2025. The main change is the total exemption of the electricity tariff for consumption up to 80 kWh/month for low-income families. The benefit granted by the federal government took effect on July 5, 2025.

According to the government, the measure is part of the People’s Light program and can reach about 60 million Brazilians who meet the criteria. The exemption covers energy and distribution tariffs up to the limit of 80 kWh.

The ANEEL regulated the application of the new rules on June 10, adjusting distributors’ procedures to reflect the exemption on the bill starting from the effective date. Congress approved the text on September 17–18, 2025, consolidating the zero tariff up to 80 kWh while maintaining charges for any consumption beyond that.

Who Is Eligible for the Federal Government Social Electricity Tariff

Eligibility is granted to families registered in CadÚnico with a per capita income of up to half the minimum wage or beneficiaries of the BPC. Families with up to three minimum wages of total income who have a member that depends on electrical equipment for health treatment also qualify. Indigenous and quilombola individuals registered in CadÚnico are also included.

The grant of TSEE is automatic for those who meet the requirements and have an updated registration. In the absence of a discount, the holder must contact the distributor for regularization.

To maintain eligibility, it is essential to periodically update CadÚnico and ensure that the holder is linked to the correct consumption unit. A family unit can only apply the benefit to one energy bill.

Families using electrical equipment for health reasons must provide a medical report to the distributor to qualify under the specific rule.

How Much It Costs and Who Pays

The new design of TSEE is expected to mobilize up to R$ 7.83 billion in 2025 to cover the low-income social tariff, according to technical estimates used by ANEEL. For this year, the additional impact of the MP between July and December that effectively enters the budget was calculated at R$ 1.147 billion.

This expenditure is within the budget of the Energy Development Account (CDE), which totals R$ 49.2 billion in 2025. The CDE is funded by charges on tariffs and other sectoral sources, not being a direct expense of the Treasury. Even so, the effect is relevant economic-fiscal and appears in the electricity bills of other consumers.

The CDE for 2025 recorded a 32% increase compared to 2024, driven by various subsidies, including the expansion of TSEE. CNN Brasil and other outlets highlighted that R$ 46.8 billion of this total will be paid by consumers via tariffs.

In practice, therefore, the “<strong(cost to the public coffers)” corresponds to the amount mobilized in the CDE to enable the exemption, with sectoral transfer and diffuse impact on the tariff. Transparency and monitoring will be central to measuring social gains and the effect on bills.

What the Exemption Covers and What Is Excluded

The exemption up to 80 kWh applies to the energy and distribution tariff. Taxes and public lighting contributions may still be charged, according to state and municipal laws. This means that the bill may show residual values.

If consumption exceeds 80 kWh in a month, the consumer pays only the excess, with no discounts on the higher tiers. This rule simplifies the old model of tiered discounts and provides predictability to the household budget.

For consumers with three-phase installations, ANEEL adjusted the availability charge to ensure that the exemption up to 80 kWh is also realized, avoiding minimum charges greater than the exempt consumption.

How to Request, Prove, and Maintain the Benefit

The first step is to be registered in CadÚnico with updated data. Registration and updates can be made at the CRAS. After this, automatic cross-referencing enables TSEE; if it does not occur, contact the distributor.

Have on hand ID, CPF, NIS, proof of income and residence. For electro-dependent individuals, present the required medical report and certificate from the distributor. Many procedures can be initiated online on the concessionaire’s websites.

Review your bill monthly and check for the identification “Low-Income Residential”. If there is an error or loss of the benefit due to outdated registration, regularize it and request the correction.
