A new bill under discussion in the Chamber of Deputies, PL 5990/2025, could radically change the work of content creators in Brazil. Presented in 2025 by deputy Vicentinho Júnior (PP TO), the text limits the activities of influencers without academic formation, technical certification, or compatible professional qualification on topics considered technical or sensitive.

According to the proposal, these content creators would be prohibited from disclosing guidelines, recommendations, or information on matters related to health, finance, alcoholic beverages, gambling, agricultural pesticides, tobacco, and its derivatives, including in advertising campaigns, if they do not meet the required qualification.

What The New Bill Says

PL 5990/2025, classified as a new bill to regulate digital content on technical topics, aims to reduce the spread of inaccurate or potentially harmful information to the public.

The proposal directly targets influencers who speak on sensitive issues without having specific training in the field.

According to the text, technical topics should be addressed only by those who have academic formation, technical certification, or compatible professional qualification.

The justification presented by the parliamentarian is to protect consumers and users of digital content from practices that may pose risks to health, safety, or property.

Who Can Be Prohibited From Speaking On Technical Topics

Under the new bill, influencers without academic formation or compatible qualification would have their activities restricted in certain niches.

It is not just about doctors, lawyers, or economists, but any professional who can prove qualification in the area addressed.

In practice, a content creator without a degree, certification, or corresponding professional registration would not be able to produce posts that appear as technical guidance.

Posts with tips, recommendations, or explanations on sensitive subjects would require proof of qualification, under the risk of sanctions.

Which Topics Are On The Restriction List

The text of PL 5990/2025 presents a list of areas where the activities of unqualified influencers would be prohibited.

Among the topics covered are:

  • Medicines, therapies, medical services, and procedures
  • Alcoholic beverages
  • Tobacco and its derivatives
  • Agricultural pesticides
  • Betting services and games of chance
  • Banking and financial services and products

The prohibition does not limit organic posts. Participation in advertising campaigns in these segments would also be prohibited for those who do not have the required education or qualification, maintaining the same standard of restriction.

Rules For Sponsored Content And Advertising

The new bill addresses not only who can speak, but also how advertising must appear on social media.

In sponsored posts, even qualified influencers would have to follow specific rules of transparency.

The text requires that the content creator clearly and visibly inform that it is advertising, identify the sponsor, and include objective alerts about the risks associated with the use or consumption of the advertised product or service.

The idea is to prevent the public from confusing advertising with technical opinion or neutral recommendation.

Fines, Warnings, And Suspension Of Accounts

In case of non-compliance with the rules, the bill creates a system of progressive sanctions.

The first stage is a warning with a deadline for correcting behavior, allowing the influencer to adjust their practices before facing more severe penalties.

If violations continue or situations considered more serious occur, the new bill provides for a daily fine that can reach R$ 50 thousand.

In addition, in cases of recurrence or greater severity, the proposal authorizes the temporary suspension of the influencer’s account for up to 90 days, without prejudice to other responsibilities already foreseen in current legislation.

Impact On Influencers And The Public

In practice, the new bill could redefine the operating space of influencers on topics such as health, money, alcohol, gambling, agricultural pesticides, and cigarettes, concentrating this content in the profiles of qualified professionals.

The measure affects both those who produce informational content and those participating in marketing campaigns in these sectors.

For content creators, especially those who have built an audience on technical topics without a degree, the risk is having posts removed, receiving fines, and even getting accounts suspended for 90 days.
