The case in which a architect received R$ 10 thousand by mistake in the Federal District, in September 2024, exposed the serious legal and social consequences of attempting to appropriate an amount received improperly. After a businesswoman made a mistake with a single digit while making a Pix transfer to her husband, the 53-year-old professional not only refused to return the money but also initiated a series of calculated actions to disappear and avoid any contact, turning a common mistake into a criminal act.
What seemed like a simple mistake, easily reversible with a straightforward return, quickly escalated into a complex police case that serves as a warning in the era of instant transactions. The architect’s initial refusal was followed by contact blocking, deactivation of her phone line, and changes to her social media profiles, in a clear attempt to become unreachable. The situation was only resolved when the victim filed a police report and the Civil Police of the Federal District (PCDF) intervened directly, locating the woman and forcing the return of the amount under the threat of criminal charges.
The Disappearance Attempt: Blocking and Silence After the Pix
It all started with a mistake that could happen to anyone: while trying to transfer R$ 10 thousand to her husband, a businesswoman typed an incorrect Pix key, and the amount ended up in the architect’s account.

With these actions, what was a mistake turned into a deliberate and malicious act, indicating the intention to retain the amount.
Instead of cooperating to resolve the problem honestly, the professional began actively trying to hide, clearly intending to keep money that, according to the law, did not belong to her, ignoring the ethical and legal implications of her actions.
The Police Intervention: When the Refusal Became a Police Case
Faced with the architect’s absolute silence and digital disappearance, the businesswoman realized that she would not be able to recover the money on her own and that she was dealing with a clear attempt at appropriation.
The only viable alternative was to take the case to the competent authorities.
She went to a Civil Police station in the Federal District and filed a complete Police Report (B.O.), detailing the incident, the amount, the identity of the recipient, and the frustrated contact attempts, which served as evidence of bad faith.
With the B.O. formalized, the police initiated an investigation for the crime of appropriation of items obtained by mistake, as provided in Article 169 of the Penal Code.
Using the provided data and investigation tools, the agents managed to locate the architect despite her attempts to disappear, and formally summoned her to appear.
At the police station, she was informed that she was the target of a criminal inquiry and that if she did not return the R$ 10 thousand, the case would proceed to court, with serious consequences for her personal and professional life.
The return occurred not by her own will, but as a direct consequence of police intervention, demonstrating that the threat of criminal action was the only factor that made her relent.
Return Does Not End the Case: The Legal Consequences
Although the return of the money resolved the businesswoman’s immediate financial problem, it does not extinguish the architect’s criminal responsibility.
Legally, the crime of appropriation was committed at the moment she, aware of the mistake, refused to return and actively tried to hide.
The subsequent return is considered “subsequent remorse” under the Penal Code, an act that can lead to a sentence reduction of one to two-thirds, but does not eliminate the fact that a crime was committed and recorded.
The case could still be forwarded to the Public Prosecutor’s Office, which would decide whether to file a formal charge.
Given that it is a crime of lesser potential harm (penalty of up to one year of detention), one possibility would be the offer of a penal transaction.
This is an agreement in which the accused agrees to serve an alternative punishment, such as community service or a fine payment, to avoid the progress of the case and a possible conviction that would stain her criminal record.
Besides the criminal sphere, in the civil area, the businesswoman would have the right to sue the architect for moral damages, arguing that all the stress, anxiety, and the need to involve the police to recover her money far exceeded mere annoyance.
