Haddad’s Announced Measures Package Proposes Changes to Gasoline ICMS; New Government Expects to End the Year in the Black with a Primary Surplus of R$11.13 Billion

The Package of Measures Announced by Haddad, Minister of Finance, Was Published This Friday (01/13) in the Official Gazette of the Union (DOU).

In a press conference on Thursday (January 14), the minister outlined a series of actions to restore the country’s public accounts in this package of measures announced by Haddad, such as the creation of a zero-litigation regime, a Refis – a measure to renegotiate debts with discounts – for people in default with entities and micro and small businesses.

Despite the current deficit, the government expects to close the year in the black with a primary surplus of R$ 11.13 billion. According to the Annual Budget Law (LOA), this year’s budget is expected to present a deficit of R$ 231.5 billion. Haddad noted that only under the best circumstances would there be a surplus of 0.1% of GDP. However, the actual forecast is a deficit of less than 1% of GDP, equivalent to an amount between R$ 90 billion and R$ 100 billion.

Changes to the Package of Measures Announced by Haddad

See what was announced by the Minister of Finance this week:

1) “Zero Litigation” Program

The measure would allow taxpayers to resolve tax disputes with the government, while allowing resources to flow into the state coffers. The design of the program is basically divided into two schemes. For individuals, micro and small businesses, the discount is up to 50% of the total debt and the term is 12 months. In this case, the debt must be 60 minimum wages.

For legal entities with debts exceeding 60% of the minimum wage, the discount on interest and penalty amounts can be up to 100%. The plan also provides for the use of tax losses and negative calculation bases to regularize between 52% and 70% of the debt.

It also provides for the elimination of appeals to the Administrative Council of Tax Appeals (Carf) for amounts under R$ 15 million. That is, if the taxpayer wins the case in the first instance, the process will be automatically closed. As a result, nearly one thousand processes currently in CARF are expected to disappear automatically, totaling about R$ 6 billion.

There will also be a 100% discount on fines (official and suspended) in the case of regularizations and tax declaration amounts. According to calculations by the economic team, Kraft has over 30,000 processes, and the amount exceeds R$ 720 million. The Federal Revenue has over 170,000 processes totaling about R$ 3 billion.

2) ICMS in the Calculation Base of PIS/Cofins

One of the measures in the package establishes that PIS/Cofins will not be calculated on ICMS, and therefore, credits will no longer be calculated in this manner.

According to Haddad, a decision on the matter will only be made after the candidate for the presidency of Petrobras appoints Paul Plates to the position. President Lula promised to change the pricing policy of the state-owned company, which is now linked to the exchange rate of the dollar and the price of crude oil in the international market. During the announcement of the first economic measures of the Lula government, Haddad said the government estimated the collection of PIS/Cofins on fuels based on the current law, but the president may reassess the deadline for reducing federal taxes on these products.

3) Return of the Quality Vote at Carf

The results of voting at Carf were resumed after a tie in favor of the Coalition in a tax dispute with taxpayers by the Tax Resources Management Committee, which judges tax disputes. When voting, the chances of revenue generation are higher, thus increasing revenue.
