Judge Applied CNJ Protocol With Gender Perspective and Recognized Serious Security Failure After Route Deviation in Ride Mediated by App
The 5th Recursal Panel of the Bahia Court of Justice increased the compensation for moral damages from R$ 5 thousand to R$ 20 thousand to be paid by Uber do Brasil to a passenger who was injured when jumping from a moving motorcycle.
The reporting judge, Eliene Simone Silva Oliveira, applied the Protocol for Judging with Gender Perspective of the National Justice Council, as provided in Recommendation 128/2022.
In the judge’s assessment, the case goes beyond a common contractual problem and involves a situation of extreme risk and significant psychological distress, given the expectation of safety associated with the service mediated by the platform.

What Happened in the Motorcycle Ride
According to the passenger’s account, the incident occurred on the night of November 29, 2024, during a ride requested via app in Bahia.
She states that the motorcyclist altered the route considered safer and took a deserted path, alongside a thicket. When she asked to return to the original itinerary, she was reportedly not attended to.
Fearing sexual violence, the woman jumped from the moving vehicle and fractured her left foot. According to the proceedings, the driver continued the trip.
Court Understanding of the Company’s Responsibility
The reporting judge emphasized that by profiting from the transportation mediation, the platform assumes the risk of the activity and is objectively responsible for the safety of those using the service.
The decision pointed to a “serious failure” in service delivery and cited the duty of safety provided for in the Consumer Protection Code. There was also an inversion of the burden of proof in favor of the user.
Besides the physical damage, the judge considered that the impact was broader, involving psychological consequences associated with the reported trauma.
Arguments Presented by Uber in the Action
In its defense, Uber argued that it was not a transportation company, but a technology company, acting only as a connector between users. It also contested the application of the Consumer Protection Code to the case.
The company further claimed that there was no moral damage and stated that the passenger had jumped from the motorcycle by her own decision.
However, the court recognized the consumer relationship and understood that the woman’s fear was not unfounded, considering the risk of sexual violence and feminicide highlighted in the reasoning.
Fixed Values and Reimbursement Maintained
The compensation for moral damage had been set at R$ 5 thousand by Judge Eloísa Matta da Silveira Lopes, from the 9th Court of the Consumer Special Courts in Salvador.
The passenger appealed to increase the amount, and the reporting judge raised it to R$ 20 thousand, citing punitive-educational function and the need to encourage improvement in security, selection, and monitoring of partners.
The decision also maintained the conviction for reimbursement of R$ 400.97 related to expenses with medications.

Sou motorista de app, e o que mais tem é cliente pedido pra fazer rotas diferentes porque eles acham que é mais rápido ou mais confortável por conta de excesso de lombadas ou trânsito com ônibus. Agora alegar que por conta dos feminicidios decidiu pular da moto em movimento, se a moda pega Hem, e se os homens começarem a fazer o mesmo levando em conta que há muito mais homicídios e pedirem indenização, os apps de transporte vão a falência rapidinho. Podia ter o usado o mesmo aparelho que solicitou o motorista do app pra chamar a polícia né, mas cada um reage de um jeito.

Mais um que não tem a menor noção do que diz, e tenta culpar a vítima pela atitude impensada e desrespeitosa do motor Uber. Defenda mesmo e use seus pífios argumentos, pois assim você só reforça a desconfiança e o medo entre as muitas mulheres que usam o app Uber na modalidade moto. Quando nem mesmo os homens confiarem em vocês, não reclamem!
Cara só sendo um homem pra enxergar deste jeito. Sua irmã pede um aplicativo, ela conhece o caminho e o cara passa no meio de um matagal, ela reconhece o perigo, pede pra retornar ao caminho, o cara não obedece, ela salta o cara não dá atenção se ela está bem, segue o caminho, e vc quer dar razão ao cara. Que planeta vc vive? Já tinha violência aí, aínda bem que ficou só nisso, iria haver mais violência com certeza. Cadê o motoqueiro pra de defender na justiça.
Pessoal e importante ressaltar que a única e exclusiva culpada nisso e a própria empresa, Uber . Pois ela da a opção para o motorista/motociclista de utiliza outros apps de navegação , também os motoristas correm riscos seríssimo ao seguir rotas recomendadas por apps , existem pessoas más intencionadas que chamam app para outras pessoas que nem conhece! motoristas são pais também são filhos , e tem esposas . E transporta pessoas que nem conhece e o risco para eles são maior pois estão conduzindo um Meio lucrativo para os maus elementos, como o carro carteira celular dinheiro em espécie, as fezes quando nao são mortos os meliantes andam horas condusindo um assalto seguido de um sequestro relâmpago! Fazendo o motorista pedir dinheiro para parentes fazer saques e etc depôs ainda matam os trabalhadores. então antes de virem apedrejar todos os motoristas lembrasse de se informarem primeiro…
O que está sendo comentado aqui tem a ver com um fato concreto entre uma usuária do app e um péssimo trabalhador, não distorça o fato para justificar a sua perspectiva, pois torna-se um texto sem contexto.
