Bill provides for ending the requirements of driving schools in the process of issuing a CNH based on private instruction

If the new PL is approved, the future driver will have a new option to issue his CNH, through a more agile and cheaper process        

Deputy Kim Kataguiri, aiming to make the process of issuing the National Driver's License (CNH) less time-consuming and cheaper, created Bill No. 4474/20, which provides for the authorization of classes and practical exams carried out by instructors independents, as long as they are accredited, as an alternative to traditional driving schools. Deputy Kim Kataguiri's Bill intends to make it optional for students to attend driving schools in order to be able to issue the National Driver's License (CNH). The PL is still under analysis in the Chamber of Deputies, because what the text proposes will cause changes in the Brazilian Traffic Code.

According to explanations by deputy Kim Kataguiri (DEM-SP), the PL will allow the instruction of future drivers to be carried out privately, without the student having to go to a traditional driving school. Still according to the deputy author of the project, the main objective of this measure is to reduce all the bureaucracy in the CNH issuing process, in addition to making everything less costly.

Operation of classes after approval of the Bill

If approved, the practical driving test may be carried out on a public road, with all assistance and instructions being given by an independent instructor, as long as he/she is accredited to other traffic authorities.

The accredited instructor must have his National Driver's License according to the category intended by the future driver, for at least five years after the provisional CNH, in addition to not having been penalized, also, in the last five years, without having his CNH suspended, or even impeached, where he loses the right to drive temporarily or permanently.

The instructor must also not have any proceedings in progress against him or her for these penalties, and must not have been convicted or prosecuted for any traffic offences. The vehicle that is used throughout the future driver's instruction process must contain a specific identification of the learning condition, in addition to being duly regularized and in conditions to be on a public road, in accordance with the form established by the National Traffic Council, the Contran.

PL will help future drivers, but does not intend to end traditional driving schools

The last update, the Bill that provides for the elimination of demands made by driving schools was made in mid-December 2020, when it was attached to 3181/12.

The proposal is being processed along with more than 200 other projects that change the Brazilian Traffic Code (PL 8085/14 and appended). It is important to open a caveat that the bill in question does not intend to end the driving schools, but rather to give a new option to the future driver, who can choose to follow the traditional process or give preference to the new modality of independent learning.
