According to specialists in social security law, understanding the retirement rules that prevent you from working is essential to avoid problems with the INSS and financial losses. The restrictions vary according to the type of benefit granted and the retiree’s professional history.

The retirement guarantees the worker the right to stop performing their activity, but it does not always mean a definitive withdrawal from the market. In Brazil, legislation allows retirees to continue working; however, there are specific rules that may restrict this possibility. In some cases, returning to work can even lead to the suspension of the benefit.

When Is It Permitted to Work After Retirement

Retirees due to contributory time or age can continue working normally. In these cases, it is mandatory to keep contributing to the INSS, but new contributions do not generate a second retirement. The worker retains the right to other benefits, such as sick pay and maternity leave, but without altering the value of the original benefit.

When the Law Prohibits Returning to Work

There are two situations in which the retiree cannot engage in paid activity:

Disability Retirement: Granted when the worker is considered incapable of any activity. If the person returns to work, the INSS may review the benefit and suspend payments, as the condition of incapacity ceases to exist.

Special Retirement: Aimed at those who worked in unhealthy or dangerous environments. Returning to the same type of activity that led to retirement is prohibited. If the retiree is re-employed in risky functions, the benefit is suspended.

In these cases, the identification of the employment relationship in official systems leads to the immediate interruption of payments.

Advantages and Precautions When Continuing to Work

Even with the restrictions, many retirees choose to remain in the market. The main advantages include increased income, cognitive stimulation, and the opportunity to engage in projects or areas different from the original career.

However, before making the decision, it is essential to analyze the impact on the benefit and understand that new contributions do not alter the value of the retirement already granted. It is also advisable to assess health issues and consult a specialized lawyer or accountant to clarify legal and contractual points.
