Senate Proposes Legislative Measures to Curb Illegal Discounts on INSS Benefits and Ensure Refunds

Frauds in Association Deductions on Retirement and Pensions

After the launch of Operation Without Discount on May 9, 2025, the Federal Senate began analyzing a series of bills aimed at addressing illegal deductions from INSS benefits. The initiative seeks to reinforce the legal protection of policyholders and ensure the return of amounts charged without authorization. The proposals arise after a report from the Federal Police and the Office of the Comptroller General (CGU) that points to undue charges made by unions and associations, which, since 2019, have entered into agreements with the INSS without the proper consent of retirees and pensioners.

Report Reveals Irregularities and Losses from Illegal Deductions at INSS Exceeding R$ 6 Billion

According to the CGU, over 97% of deductions directly taken from pension benefits lacked formal authorization from the beneficiaries. The estimated loss between 2019 and 2024 exceeds R$ 6.3 billion. In light of this scenario, the National Congress initiated a legislative process to propose regulatory and administrative solutions that increase transparency in the relationship between INSS, beneficiaries, and private entities.

Legislative Proposals for Accountability Control

Between May 10 and 13, 2025, senators from different parties presented six coordinated bills to address undue deductions. Among the proposed bills, PL 1.899/2025, from Eduardo Girão (Novo-CE), requires annual revalidation with documentation and biometrics. On the other hand, PL 1.901/2025, also authored by Girão, holds INSS accountable even without proven fault. Meanwhile, PL 1.950/2025, proposed by Flávio Bolsonaro (PL-RJ), sets a 90-day deadline for the return of unauthorized amounts. Similarly, PL 2.159/2025, from Rogério Marinho (PL-RN), establishes a six-month suspension of deductions. Additionally, PL 2.194/2025, presented by Ciro Nogueira (PP-PI), prohibits direct charges on benefits. Finally, PL 2.201/2025, from Cleitinho (Republicanos-MG), states that association payments should occur only through external means.

Resumption of Previous Project Expands Legislative Debate

In addition to the new proposals, Senator Paulo Paim (PT-RS) requested the reactivation of PLS 206/2015, which provides for the double return of amounts deducted irregularly. The proposal, previously shelved, began to progress with priority in the Senate starting May 13, 2025.

Actions of INSS: Notifications and Official Channels

According to the Ministry of Social Security, INSS began sending notifications on May 13, 2025, to about 9 million beneficiaries. The messages alert about the existence of active association deductions in the payment statements. Policyholders can confirm or contest the deductions through the following official channels: the Meu INSS app or the phone number 135. However, if the deduction is contested, the responsible entity must present valid documentation proving the authorization within 15 business days. Otherwise, it must reimburse the amount to the INSS, which will pass the sum on to the beneficiary.

Mixed Parliamentary Inquiry Commission Will Investigate Frauds and Irregularities in Undue Deductions in INSS

On May 13, 2025, a formal request was filed for the creation of a CPMI to investigate irregularities. The commission will have 15 senators and 15 representatives as regular members, with an equal number of substitutes and an initial duration of 180 days, with the possibility of extension. The proposal aims to ascertain responsibilities, review administrative processes, and propose structural solutions to prevent future incidents.

Guidelines for Beneficiaries to Avoid Unauthorized Deductions

INSS beneficiaries should pay attention to their statements and act quickly in case of unrecognized charges. The guidelines are: regularly check Meu INSS or call 135, immediately contest unknown association charges, use only official government channels, and ignore contacts via WhatsApp, email, or SMS requesting information or bank details. According to INSS itself, the agency does not proactively contact individuals regarding reimbursements. All communications are, therefore, conducted exclusively through institutional channels, as this ensures greater security, clarity, and standardization of the information disclosed.

Legislative and Administrative Progress Remains Ongoing

The processing of legislative bills, the analysis of PLS 206/2015, and the establishment of the CPMI point to a coordinated legislative response. At the same time, INSS has been adopting administrative measures to review processes and increase transparency. Thus, the goal is to prevent illegal deductions from INSS benefits from occurring unchecked, safeguarding the rights of policyholders and establishing legal responsibilities when failures occur.
