The Use Of Cell Phones In Traffic Is A Common Practice, Especially In Large Cities Like São Paulo, But It Can Also Be A Real Problem If The Rules Are Not Followed. Many Drivers Opt For Smartphone Mounts To Stay Connected Without Breaking The Law, But Does This Prevent The Feared Fine? The Answer Is Not So Simple.

According To Lawyer Marco Fabrício Vieira, A Member Of The National Traffic Council (Contran), The Use Of Mounts For Cell Phones Is Legal. However, Attention Is Needed: Handling The Device Remains An Infraction. This Means That Even With The Cell Phone Fixed In The Mount, Interacting With It While Driving Can Result In Fines And Points On The Driver’s License.

The Brazilian Traffic Code (CTB) Is Very Clear About The Rules. Driving While Holding Or Typing On A Cell Phone Is A Serious Infraction. The Simple Use, Such As Answering A Call Via Hands-Free, Is Classified As A Medium Infraction. Therefore, The mount Reduces The Risks Of Committing An Infraction, But Does Not Completely Eliminate The Problem.

Fines And Penalties: What Does The Brazilian Traffic Code Say

The CTB Provides Specific Punishments For Those Who Use Their Phones Inappropriately While Driving. Check The Details:

Article 252, Item VI: Use Of A Cell Phone While Driving, Without Handling – Medium Infraction, With A Fine Of R$ 130.16 And 4 Points On The Driver’s License.

Article 252, Sole Paragraph: Handling A Cell Phone While Driving – Serious Infraction, With A Fine Of R$ 293.74 And 7 Points On The License.

These Penalties Make It Clear That Even With The Mount, The Act Of Handling The Device Is What Constitutes The Most Severe Infraction.

Cell Phone In Traffic: Impact On Road Safety

In Addition To The Penalties, There Is Also The Real Danger Of Using A Phone While Driving. Studies By The Brazilian Traffic Medicine Association (Abramet) Indicate That Diverting Attention To The Device For Just Three Seconds At 40 Km/h Is Equivalent To Traveling 36 Meters Without Looking At The Road. This Lack Of Attention Can Have Fatal Consequences.

Abramet Estimates That The Use Of Cell Phones While Driving Is Associated With 54,000 Annual Deaths In Brazil. The Divided Attention Between Driving And Interacting With Electronic Devices Is One Of The Biggest Risk Factors In Traffic.

To Avoid Accidents And Fines, Awareness Is Essential. Using The Cell Phone Mount Responsibly, Without Handling The Device While Driving, Is An Important Step For Road Safety. Respecting Traffic Rules And Adopting Conscious Use Of Technology Are Attitudes That Can Save Lives.

Brasil ! Adoro o meu país mas quanto mais eu vivo aqui mais eu vejo como as leis são engraçadas, piadas mesmo . Um motorista pode ter um celular no suporte e , claro atender e fazer ligações enquanto um motociclista não pode ter comunicador no capacete ( sem a necessidade de usar as mãos) . Qual é a lógica? Só rindo 😀😀😀😀😀😀😀
