Termination withdrawal is the most well-known and traditional modality. In it, the worker dismissed without just cause is entitled to withdraw the entire balance available in FGTS, in addition to the 40% fine paid by the employer on the deposited amount.

How Anniversary Withdrawal Works

Created to provide greater flexibility, anniversary withdrawal allows the worker to withdraw part of the FGTS balance annually in the month of their birthday. The amount is calculated in brackets, with progressive rates varying according to the accumulated amount in the account.

However, by opting for this modality, the worker gives up the right to the full withdrawal in case of dismissal, being restricted only to the 40% fine. This choice can be advantageous for those seeking immediate liquidity but poses a risk for those without job security.

Can I Return to Termination Withdrawal?

Yes, it is possible to revert to termination withdrawal after opting for anniversary withdrawal. But there is an important rule: the change only takes effect in the 25th month after the request. During this waiting period, the worker remains subject to the limitations of anniversary withdrawal.

In addition, those who have advanced amounts through credit linked to FGTS cannot revert the modality until the loan is paid off. This reinforces the importance of planning the decision in advance.

Special Withdrawal Cases

Besides the main modalities, the law provides for special situations in which the FGTS balance can be accessed, such as:

  • Purchase of a Home
  • Natural Disasters or Public Calamities

Eu fiz um simulado para ver se liberavam um empréstimo pra mim. E não deram a opção de cancelar até porque eu não tive um empréstimo aprovado, por esse motivo acho que deveriam deixar a pessoa voltar tipo num prazo de 48 horas para a modalidade saque recisão até porque não teve aprovação do empréstimo.
E como era um simulado deveria não ter a opção de aderir primeiro ao saque aniversário sem antes ter uma aprovação.

Na minha opinião não há prejuízo nenhum, afinal o saldo que estiver retido pode ser retirado por meio de empréstimos, ou mesmo anualmente pelo mesmo de aniversário, e outra o FGTS é do trabalhador, deveriam liberar a hora que o trabalhador quisesse, e não ficar na mão do governo!

Criatura… não fica na mão do governo e sim no fundo do trabalhador, que tem suas regras, do contrário seria extinto, pois quem deixaria o dinheiro lá?
