The Chamber of Deputies approved a proposal that promises to be strict for those who use their vehicles to abandon animals. The measure, which provides for imprisonment of up to 5 years and the revocation of the driver's license, seeks to hold drivers and passengers accountable.

In a proposal that promises to stir the conscience of drivers and animal lovers, the Environment and Sustainable Development Committee of the Chamber of Deputies took the first step towards impactful legislation.

The measure, which aims to severely punish the use of vehicles to abandon domestic animals, seeks to hold drivers and passengers accountable in a forceful manner, as a way of curbing this type of cruelty on the streets of Brazil.

This initiative, which has already gone through an approval phase, sparks a debate: will strict punishments finally be able to curb the abandonment of animals on the country's public roads?

Proposal and strict penalties

The text of the approved proposal defines abandoning animals on public roads as a crime and, at the same time, a very serious traffic violation.

The measure establishes strict penalties for those who use vehicles to abandon property, with punishments that can include up to five years imprisonment e revocation of National Driver's License (CNH) to the offender.

In addition to the driver, Passengers who assist or ignore the situation may also be penalized with the same penalties.

Under the proposal, the practice of abandonment would be characterized as both a traffic violation and a crime in itself, applying heavy penalties. 

The very serious traffic violation includes fines and immediate withdrawal of the license.

According to rapporteur deputy Nilto Tatto (PT-SP), the new text brings together main ideas from four different projects related to the topic.

It specifies that abandoning animals is โ€œpunished with a fine, revocation of the driver's license and imprisonment of up to five yearsโ€, in addition to the prohibition of obtaining a new driving license.

The evolution of the proposal

The path to this measure has been paved since the presentation of the 25 / 24 Bill by Deputy Delegate Matheus Laiola (Uniรฃo-PR), to which three other projects were attached: PL 236/24, PL 951/24 and PL 257/24.

The text now brings together the ideas of the four projects in a single substitute, facilitating legislative processing.

As explained by rapporteur Nilto Tatto, the proposal aims not only to characterize abandonment as an infraction, but also to give a stricter classification to the abandonment of animals as a crime.

This articulation of proposals in a single project was a solution found to make the approval and effectiveness of the measures viable. 

With this, the substitute bill aims to directly affect drivers' awareness. and create a deterrent effect on the abandonment of animals on the streets.

Next steps in the process

The proposal, still in a conclusive nature, will be analyzed by the committees of Transport and Roads e Constitution and Justice and Citizenship.

Once approved by both, it will go to the Senate and, finally, to the President for approval to become law.

This new measure represents a legislative attempt to combat animal abandonment, a historic and recurring problem in Brazil.

For animal rights advocates, the measure is a fundamental step forward.

According to representatives of animal protection organizations, stricter laws play a fundamental role in educating society and inhibiting the practice. 

There is great pressure for the measure to also be approved in the Senate., as many see it as an effective tool to combat a behavior that still occurs frequently.

Implications for drivers and society

If approved, the new legislation signals a significant shift in driver accountability, establishing that vehicles cannot be used as a tool to practice abandonment.

The implications are significant, as the offender will not only lose the right to drive, but could also face years in prison, a consequence not previously seen in cases of animal abandonment.

As rapporteur Nilto Tatto highlights, the application of strict penalties aims to create a real and dissuasive impact.

The initiative follows other international proposals and legislation aimed at protecting animals, although it represents a novelty in the Brazilian traffic and legal system.

Given this proposal, the issue raises questions: will punishment be enough to change the behavior of offenders? What will be the impact on society in general?

Are you worried about punishing those who abandon animals? You have to change the law so that those who kill in traffic, people die in traffic every day and they won't be arrested, so they'll have to serve a sentence with an ankle bracelet. How are you going to solve anything? The person who kills in traffic is the same person who kills on the street, etc.

I am the kind of person who does not accept impunity or injustice. Even more so against a being who not only gives love and sincere affection, even when its owner often mistreats it. A harsh punishment is indeed necessary for these people without feelings.

It's obvious that those who abandon animals must be punished. And those who kill them in traffic too. One thing doesn't cancel out the other. The proposal was made by a politician who fights for the **** cause. Go and demand this other law from those you voted for. If you don't care and don't like animals, you've probably abandoned one yourself, that's your problem. Don't come criticizing those who want to do something for them.

Regarding those who kill in traffic, I agree with you, my friend, but even a homeless person who falls on the street and is run over will have free medical care and assistance, but animals do not have this privilege. Who stops on a highway to save or help a ****? Dude, less than 1% of drivers stop and at least try to help a ****, so whoever gives a life to less than 1% of chances, even more so if it is a defenseless being, must pay dearly for this cruel act. I agree that whoever is caught drunk should be punished more severely, like 2 years of basic food basket depending on the offender's income and also a suspension of the driver's license or a heavy fine and bail. Now, if you get involved in an accident while drunk, dude, suspension and **** for the drunk.

I thought the same thing, as always the parliamentarians wanting to play to the audience, jumping on the bandwagon of the โ€œanimal protectorsโ€, if the person canโ€™t abandon an animal by car, theyโ€™ll go by bike, or theyโ€™ll kill and bury it, itโ€™s like the Maria da Penha law, made to โ€œprotectโ€ women, condemning them to death! Good evening! I think this new law is amazing. I completely agree. Someone has to look after the animals. It's about time. They should be strict in enforcing the law.
