The City Hall of Macaé has begun to prohibit the use of sound amplifier boxes and any sound amplification devices on the sand and on the sidewalks of the beach in the municipality.
The prohibition is stated in the decree No. 303/2025, published in the Official Gazette, and is already in effect, according to the municipal administration.
The text provides for verbal warning as the first measure and establishes that it must occur in the presence of at least two identified public agents.

If there is persistence in using the equipment after the warning, the inspection may seize the device and impose an administrative fine of 100 Municipal Reference Units (URMs), in addition to opening an administrative process to formalize the sanctions and ensure due process and broad defense.
Ban On Sound Boxes On The Sand And Shore
The ban covers sound amplifier boxes, similar equipment, and any devices intended to amplify, reproduce, or disseminate sounds audible to the general public.
In the official communication, the City Hall indicates that the rule applies to both portable and fixed equipment, as long as they have sound amplification function.
A central point of the decree is the way the rule was described for everyday application.
The prohibition was presented as valid regardless of time, emitted volume, and purpose of the equipment, meaning that the infraction does not depend on decibel measurement or assessment of low or high volume.
Supervision By The Municipal Guard And Regulations

Supervision will be the responsibility of the Municipal Guard and the Special Coordination for Supervision and Regulations.
According to the City Hall, the agencies can act together or separately.
This allows actions at different points along the shore, according to internal planning and received demands, such as complaints from residents and visitors.
In the first approach, the guidance communicated is that verbal warning should always be the initial step.
The warning should occur in front of at least two identified agents.
Only if the user continues using the equipment after the warning can the supervision apply seizure and fines.
The decree also provides for the initiation of an administrative process for the application of sanctions.
This procedure formalizes the occurrence, records the penalty, and ensures the possibility of defense, as per municipal legislation.
Value Of The Fine Of 100 URMs In Reais
The financial penalty has been set at 100 URMs, a reference that requires conversion to reais according to the current fiscal year.
The City Hall informed that, for 2026, the URM has been defined as R$ 4.9604, with publication by the Municipal Treasury on December 30, 2025.
With this value, the fine corresponds to R$ 496.04, exceeding R$ 490.
According to the administration, the amount reinforces the punitive nature of the rule for those who persist in using amplified sound in prohibited areas.
The return of the seized equipment is conditioned to payment of the fine and compliance with legal requirements.
Exceptions Foreseen In Decree No. 303/2025
The City Hall informed that the decree provides for specific exceptions.
Among them are events previously authorized by the public authorities.
It also includes institutional, educational, cultural, or sports activities promoted or supported by the City Hall.
The official communication also mentions rescue, safety, or supervision actions carried out by public agencies.
Religious manifestations may be classified as exceptions, provided they have prior authorization and comply with noise control legislation.
The existence of these exceptions is considered relevant during periods of higher beach occupancy.
At the same time, the decree stipulates that authorization and compliance with noise rules are requirements to avoid characterizing infraction.
Link With The Municipal Noise Control Law
The City Hall states that decree No. 303/2025 is aligned with the Municipal Law No. 5.186/2024, which addresses noise emission control and sound pollution in Macaé.
By linking the measure to this legal framework, the administration frames the restriction on the beaches as part of a broader urban planning policy.
In the justification released, the municipality points out objectives such as preserving public peace, health, safety, and collective well-being.
The beach, especially on weekends and in the summer, sees a large influx of people and different forms of use of the space.
This scenario tends to amplify coexistence conflicts related to the use of amplified sound.
The City Hall did not elaborate on a specific inspection schedule or the number of teams dedicated solely to the issue.
