The National Institute of Social Security (INSS) is about to make a remarkable payment: R$ 750 million.

The amount will be allocated to around 42 thousand insured who were harmed by a calculation error in disability benefits released between 2000 and 2011.

This revision, which affects retirees, pensioners, and beneficiaries of pensions, promises to correct a historical flaw in the INSS benefits system.

The payment is expected to occur by May 31, 2025.

These insured individuals, who have active benefits or have already passed away, are entitled to an adjustment of the amounts paid in accordance with the revision of Article 29.

Some beneficiaries can already check if they are included in the list of recipients, using the Meu INSS app or accessing the official website of the institute.

This action is part of a correction process initiated after a judicial agreement made between the Sindnapi (National Union of Retirees, Pensioners, and the Elderly) and the Social Security, which resulted in the revision of amounts, correcting the error made by the INSS.

Understand the Historical Error and the Impact on Insured Individuals

The error made by the INSS dates back to the 2000s and affected thousands of insured individuals who requested disability benefits, such as sickness aid, accident aid, death pensions, and disability retirement.

The problem originated in the calculation of the amounts of these benefits, which resulted in an underestimation of the amounts paid to many insured individuals.

This error directly impacted the pensions and retirement benefits of about 140 thousand insured people, who should have received larger amounts than those actually paid between 2012 and 2022.

About 42 thousand people have active benefits and will be the first to receive the correction, with payments being made by the end of May 2025.

The Role of Sindnapi in Correcting the Error

In 2024, the Sindnapi, which represents the interests of retirees and pensioners, filed a lawsuit against the INSS, seeking the correction of the amounts.

The union, which had already achieved a similar revision in 2011, after a judicial intervention, mobilized the courts again to ensure that the insured affected by the original error would finally be compensated.

According to lawyer Camila Almeida, a representative of Sindnapi, the revision covered insured individuals who were on the list from the 2011 agreement but had not received the amounts due by 2022.

“These insured individuals were on the list, but the payment was made in a staggered manner, and not everyone was covered. Now, we are ensuring that those who were left out receive what is owed,” the lawyer explains.

How INSS is Resolving the Problem

The process of regularizing the payment of the amounts due includes the cross-referencing of data between the INSS and the insured individuals entitled to the revision.

Camila Almeida states that currently, 42 thousand active benefits have already been calculated and are ready to be paid.

These insured individuals will have their amounts corrected, with deposits expected by the end of May.

However, the remaining 140 thousand insured individuals who qualify for the revision will not have immediate payment.

This is because many of these benefits were suspended or terminated, such as those for sickness aid or disability pensions that were paid for a temporary period.

The identification of these insured individuals has been a challenge, as it is necessary to verify each case to ensure that all entitled to payment are included in the process.

However, according to the lawyer, the expectation is that all beneficiaries will be served throughout the year 2025.

Understand the Different Types of Benefits That Were Affected

The benefits being revised include a wide range of incomes provided by the INSS to workers and their families.

Among the most affected are:

  • Disability Retirement: Granted to workers who have become permanently unable to perform any professional activity.
  • Death Pension: Benefit paid to dependents of an insured individual who has passed away.
  • Sickness Aid: Temporary benefit granted to workers who are incapacitated for work due to health reasons.
  • Accident Aid: Benefit paid to workers who suffer work-related accidents and are left with permanent sequelae.

All these types of benefits were affected by errors in the calculation of amounts, creating a financial imbalance for insured individuals who did not receive the fair amounts they were entitled to.

The Impact of the Correction on Beneficiaries

The impact of this correction is significant.

Many beneficiaries who have waited years for the correct amounts to be paid will now be able to see the difference in the amount of their pensions or retirements.

For many, this revision represents an important financial compensation for decades of work and contribution to the INSS.

Additionally, the payment of R$ 750 million is a great relief for the finances of over 42 thousand families, who have their rights restored.

The correction will also have a positive effect on the credibility of the INSS, which by correcting its mistakes, demonstrates an effort to repair past failures.
