Package Approved by Congress Includes Constitutional Amendment 137, Zero IPVA for Vehicles 20 Years or Older Starting in 2026, Conditional Automatic Renewal of Driver’s License, Social Driver’s License Funded by Fines, Free Digital Document, and Forecast of Up to R$ 6 Billion for Renewal of Truck Fleet in the Country
The Senate approved in 2025 a package of measures that reduces costs for drivers, including zero IPVA for vehicles 20 years or older starting in 2026, changes to the Driver’s License, and new financing options, with a direct impact on household budgets and national transport.
The end of IPVA for older vehicles arises from the promulgation of Constitutional Amendment 137, originating from PEC 72/2023, which establishes automatic exemption from the tax for vehicles 20 years or older in the entire country.
In Minas Gerais, the impact is illustrated by owners of popular cars manufactured in 2005, who in 2025 paid between R$ 400 and R$ 600 in IPVA and, starting in 2026, will no longer pay any amount.

The new rule aims to standardize state criteria, since five states did not have a defined deadline or imposed stricter rules for exemption, creating regional differences in the cost of keeping older vehicles in circulation.
Minas Gerais and Pernambuco did not set an age limit for exemption, while Santa Catarina, Tocantins, and Alagoas required a longer manufacturing time, according to their own rules applied until the constitutional amendment was approved.
Scope of IPVA Exemption
Constitutional Amendment 137 stipulates that the IPVA exemption applies to passenger cars, pickup trucks, mixed-use vehicles, minibuses, buses, trailers, and semitrailers that are at least 20 years old.
During the promulgation on December 9, the President of the Senate and the National Congress, Davi Alcolumbre, stated that the measure corrects a tax distortion that penalized lower-income families.
According to him, automobiles that are more than two decades old do not represent accumulated wealth, but rather a daily necessity, often being the only means to maintain employment, take children to school, or ensure transportation to work.
Author of the PEC, Senator Cleitinho, from the Republicanos party of Minas Gerais, stated that the budgetary effect is significant, highlighting that only in his state the measure transfers approximately R$ 1 billion from the public purse to the population.
The senator emphasized that the tax reduction increases families’ purchasing power and alleviates fixed expenses, especially in regions where individual transportation remains essential for daily commuting.
Automatic Renewal and Digital Driver’s License
In addition to the IPVA, Congress is discussing changes to the Brazilian Traffic Code through Provisional Measure 1,327/2025, which allows for the automatic renewal of the Driver’s License for drivers with no infractions in the previous 12 months.
The provisional measure is already in effect but needs to be confirmed by deputies and senators to become a definitive law, as provided for in the Federal Constitution.
According to the text, drivers aged up to 49 will be able to renew their Driver’s License automatically as long as they meet the required criteria, without the need for additional in-person procedures.
Drivers between 50 and 69 years old will have the right to automatic renewal only once, while drivers aged 70 and older are excluded from the new rule set out in the provisional measure.
The text also guarantees free issuance of the Driver’s License in digital format, keeping the physical version as optional, with both formats valid as official identity documents throughout the national territory.
Congress has until March 2026 to analyze Provisional Measure 1,327/2025 and decide on its permanent conversion into law.
Social Driver’s License and Toxicological Test Requirement
Another approved initiative involves the creation of the Social Driver’s License, established by Bill 3,965/2021, which allocates part of the funds collected from traffic fines to cover the licensing costs for low-income individuals.
The proposal was sanctioned in June and transformed into Law 15,153, of 2025, establishing mechanisms to reduce the cost of access to driver’s licenses in the country.
In addition to the Social Driver’s License, the law introduces rules for the electronic transfer of vehicles and adjusts the requirement for toxicological testing to obtain the license.
Candidates for the first Driver’s License in categories A and B, designated for motorcycles and cars, are now required to present a negative toxicological test, a requirement previously restricted to categories C, D, and E.
These categories include drivers of cargo vehicles and public transportation, who were already subject to the test as a condition for obtaining and renewing their professional license.
A survey by Ipec, conducted in February 2025, indicates that 83% of Brazilians support making the toxicological test mandatory, demonstrating broad social support for the adopted measure.
Practical Lessons and Debate in the Senate
The relaxation of the requirement for practical lessons in driving schools came into effect through a resolution from the National Traffic Council, but generated debate in the Senate about potential impacts on road safety.
The leader of the PT in the Senate, Rogério Carvalho, from Sergipe, defended the change as a tool for social inclusion, stating that obtaining a license is a gateway to the job market.
According to the senator, low-income individuals face challenges to cover the licensing process, and the relaxation broadens access without completely eliminating the necessary training.
On the other hand, the opposition’s deputy leader, Senator Marcos Rogério, from the PL party of Rondônia, classified the removal of the auto school requirement as a controversial issue and called for more debates in Parliament.
For him, training remains essential, as ignorance of traffic rules compromises the ability to obtain and maintain the license safely, as he stated in a discussion in the Senate.
Exemption for Professional Drivers and Truck Fleet
The Bill 1,248/2022, authored by Senator Randolfe Rodrigues, from the PT party of Amapá, is still pending in the Senate, which provides for exemption from renewal fees for professional drivers’ licenses.
The proposal benefits drivers engaged in the transportation of passengers and goods, reducing recurring costs for workers who depend directly on the license to perform their profession.
Another initiative under analysis is Provisional Measure 1,328/2025, published on December 16, which allocates up to R$ 6 billion for financing new or used trucks.
The goal is to promote the renewal of the road freight transport fleet, expanding access to credit for independent transporters, cooperatives, individual entrepreneurs, and companies in the sector.
The resources may be used by individuals and legal entities, strengthening national logistics and complementing the set of measures approved to reduce operational costs in transportation.
The initiatives, analyzed together, constitute a legislative package that combines tax reduction, expanded access to licensing, regulatory adjustments, and financing incentives, with direct effects on drivers and the transportation sector in the country.
