2026 Regulations Rearrange CNH Deadlines According to Age, Create Automatic Renewal, Maintain In-Person Exams for Seniors, Impose Drug Tests for Categories C, D, and E, and Detail Penalties After Expiration

The 2026 traffic calendar consolidates validity rules for the National Driver’s License based exclusively on the driver’s age, introduces automatic renewal for good drivers, and reinforces medical restrictions for seniors, directly impacting the routine of millions of license holders.

CNH Validity Determined by Age in the Medical Exam

Traffic legislation establishes that the validity of the CNH is determined by the driver’s age at the time of the mandatory medical examination. Up to 49 years, the document remains valid for 10 years.

Between 50 and 69 years, the validity decreases to five years, reflecting a greater need for monitoring physical and mental conditions over time.

For drivers aged 70 years or older, the maximum allowed period is three years, requiring more frequent renewals and mandatory in-person evaluations.

The medical expert has the technical autonomy to reduce any term if issues such as uncontrolled hypertension, diabetes, or signs of progressive diseases are identified.

This decision is independent of formal age and seeks to ensure that the driver maintains adequate conditions to drive safely.

Automatic Renewal and Limits by Age Group

The main novelty for 2026 is the automatic renewal of the CNH for drivers with a good traffic record, registered in the Positive Registry.

The benefit allows for digital renewal without immediate in-person attendance, provided there are no serious infractions in the last 12 months.

Drivers aged 50 to 69 years can use automatic renewal only once consecutively, with mandatory alternation with in-person exams.

For drivers aged 70 years or older, automatic renewal is prohibited, maintaining the requirement for an in-person medical evaluation every three years.

This restriction aims to ensure that reflexes, vision, and cognition remain compatible with defensive driving in modern traffic.

Additional Rules for Categories C, D, and E

Drivers licensed in categories C, D, and E follow the same age rules but must meet additional requirements related to drug testing.

Renewal is only authorized when the negative report from the drug test is properly registered in the Renach.

Drivers in these categories under 70 years old must also undergo periodic drug testing every two and a half years.

This requirement is independent of the expiration date printed on the physical wallet, necessitating extra attention from professional drivers.

Situation of Expired CNH and Penalties

The Brazilian Traffic Code grants an automatic tolerance of 30 days after the CNH expires, allowing driving while the renewal is being processed.

After this period, driving a vehicle becomes a serious violation, with a fine of R$ 293.47 and an addition of 7 points to the record.

In addition to the financial penalty, the vehicle is retained, released only with another licensed driver and with regularized documentation, reinforcing the importance of deadline control.
