These practices can result in sanctions, as eviction must occur exclusively through formal channels and executed by the competent authority.
Legal Exceptions to the Suspension of Evictions
The winter truce provides specific exceptions.
According to official information from the French government, situations where the occupant already has adequate relocation for the family size are not covered.
The suspension also does not apply when the property is in a building declared dangerous or unhealthy by an administrative act that dictates evacuation.
Another group excluded from protection involves occupations classified as illegal.
People occupying a residence without any legal title, including primary or secondary homes, do not benefit from the truce.
The same applies to occupations of garages or land, cases where the judge may shorten or eliminate the suspension period of eviction.
There are also exceptions related to judicial decisions in family matters.
The truce does not apply when there is an eviction order from the marital home in separation proceedings or in decisions mandating the departure of the aggressor in cases of domestic violence or against children.
Winter, Default, and Energy Supply
The logic of the truce also extends to energy supply.
During the period from November to March, total electricity cut-off due to default is prohibited in primary residences.
However, the protection does not prevent adjustments to supply.
The rules allow for reduction of electrical power, maintaining a minimum level of service, while debt collection continues and payment plans can be negotiated.
The same principle applies to gas.
French legislation prevents total interruption of supply during the winter truce, reinforcing the priority given to heating and minimum living conditions in winter.
Water Cut-off Is Prohibited Year-Round
In the case of water, the protection is permanent.
France has permanently banned the cut-off of supply in primary residences due to default, regardless of the time of the year.
The measure was introduced by a law approved in 2013 and its interpretation was confirmed by the French Constitutional Council in 2015.
In the ruling, the body validated the prohibition without seasonal limitation, considering access to water an essential service for human dignity.
Even so, the debt still exists, and distributors may resort to other legal collection mechanisms.
Illegal Occupations and Increased Stringency of Legislation
The distinction between formal leasing and occupation without legal title has become a central issue in the housing debate in France.
In recent years, legal changes have tightened the treatment of illegal occupations and adjusted the state’s response to irregular permanence in private properties.

For owners, the period is typically seen as a time to organize documentation, activate contractual guarantees, and prepare for potential resumption of execution after the end of legal protection.
Once the truce ends, eviction may be executed if there is a valid court decision, following the prescribed procedures.
Combining temporary suspension of evictions, protection against energy cuts in winter, and permanent prohibition of water supply interruption, France adopts a model of minimum housing protection in critical periods, without eliminating the right of creditors to collect.
