French Measure Suspends Evictions in Winter, Limits Energy Cuts, and Maintains Water Supply Even in Case of Debt, Creating a Seasonal Social Protection Regime for Primary Residences and Preserving Legal Claims.

France suspends the execution of evictions during the coldest months of the year while simultaneously reinforcing barriers against interruptions of essential services in primary residences.

The set of rules is known as winter truce and prevents the eviction of a tenant from being effectively carried out between November 1 and March 31 of the following year, even when there is already a court ruling authorizing the eviction.

In practice, French legislation does not erase the debt or cancel the process.

It merely postpones the physical removal of the occupant from the property during the period of highest climate risk, when intense cold makes loss of shelter a critical vulnerability factor.

According to the official portal of administrative information from the French government, the winter truce window in the 2025-2026 cycle runs from November 1, 2025, to March 31, 2026, maintaining the annual standard set by law.

Winter Truce and Eviction: What Is Suspended

The winter truce blocks the final stage of eviction, which is the execution of the court decision.

This means that the owner may have obtained a favorable ruling in court, but the execution remains suspended until the end of the period.

Nevertheless, the judicial procedure can continue, and outstanding amounts remain collectible, with the possibility of updates and increases according to the applicable rule.

The protection is not automatic for any occupation.

It was designed for situations of regular housing, where the property is the primary residence of the occupant and there is a recognized legal bond.

For the owner, the legislation interrupts forced eviction in winter, but does not remove the right to collect the debt through legal means, nor does it prevent direct negotiations.

Self-help actions, such as changing locks, removing belongings, deliberate service cuts, or coercion to force departure, remain prohibited.

These practices can result in sanctions, as eviction must occur exclusively through formal channels and executed by the competent authority.

Legal Exceptions to the Suspension of Evictions

The winter truce provides specific exceptions.

According to official information from the French government, situations where the occupant already has adequate relocation for the family size are not covered.

The suspension also does not apply when the property is in a building declared dangerous or unhealthy by an administrative act that dictates evacuation.

Another group excluded from protection involves occupations classified as illegal.

People occupying a residence without any legal title, including primary or secondary homes, do not benefit from the truce.

The same applies to occupations of garages or land, cases where the judge may shorten or eliminate the suspension period of eviction.

There are also exceptions related to judicial decisions in family matters.

The truce does not apply when there is an eviction order from the marital home in separation proceedings or in decisions mandating the departure of the aggressor in cases of domestic violence or against children.

Winter, Default, and Energy Supply

The logic of the truce also extends to energy supply.

During the period from November to March, total electricity cut-off due to default is prohibited in primary residences.

However, the protection does not prevent adjustments to supply.

The rules allow for reduction of electrical power, maintaining a minimum level of service, while debt collection continues and payment plans can be negotiated.

The same principle applies to gas.

French legislation prevents total interruption of supply during the winter truce, reinforcing the priority given to heating and minimum living conditions in winter.

Water Cut-off Is Prohibited Year-Round

In the case of water, the protection is permanent.

France has permanently banned the cut-off of supply in primary residences due to default, regardless of the time of the year.

The measure was introduced by a law approved in 2013 and its interpretation was confirmed by the French Constitutional Council in 2015.

In the ruling, the body validated the prohibition without seasonal limitation, considering access to water an essential service for human dignity.

Even so, the debt still exists, and distributors may resort to other legal collection mechanisms.

Illegal Occupations and Increased Stringency of Legislation

The distinction between formal leasing and occupation without legal title has become a central issue in the housing debate in France.

In recent years, legal changes have tightened the treatment of illegal occupations and adjusted the state’s response to irregular permanence in private properties.

Among the recent milestones is the law passed in July 2023, often described as the “anti-squat” law.

The package expanded rapid response tools to illegal occupations and reinforced sanctions in certain situations of unauthorized permanence.

Social Pause Without Forgiveness of Debts

Despite the suspension of evictions and the limitations on service cuts, the winter truce does not function as amnesty.

Rental debts continue to accrue, and legal processes may advance during the period.

The official guidance is that the interval should be used to seek debt regularization, renegotiation, or access to social support mechanisms.

For owners, the period is typically seen as a time to organize documentation, activate contractual guarantees, and prepare for potential resumption of execution after the end of legal protection.

Once the truce ends, eviction may be executed if there is a valid court decision, following the prescribed procedures.

Combining temporary suspension of evictions, protection against energy cuts in winter, and permanent prohibition of water supply interruption, France adopts a model of minimum housing protection in critical periods, without eliminating the right of creditors to collect.

In a scenario of rising living costs and pressure on the real estate market, to what extent could mechanisms like this be adapted to realities such as the Brazilian one?

É justamente isso que o Trump não quer que aconteça nos EUA a França abriru aa porteiras para refugioados de toda parte: Africa, Oriente Médio e agora os franceses que estão pagando a conta igual aqui no Brasil onde Lula deu bolsa-família pra metade da população e 25 % dos brasileiros qus trabalahm na formalidade estão pagando imposotos absurdos.
