According to the STF, the trial will take place in the virtual plenary, extending until September 25, and must include the participation of all 11 ministers. At the end of July, the Court of Accounts of the Union (TCU) issued a favorable opinion to continue the process of selling Petrobras’ refineries.
The expectation is that eight Petrobras refineries will be sold by next year, according to the agreement with Cade. Together, the units have a daily oil processing capacity of 1.1 million, about 50% of the country’s refining capacity.

Petrobras’ decision to sell part of its refining assets is in line with national energy policy and does not contradict the STF’s decision on privatizations, argued the Ministries of Economy and Mines and Energy in a joint statement previously.
The first refinery to go to market, Rlam in Bahia, is in exclusive negotiations with the Mubadala fund from Abu Dhabi. In addition, Petrobras is also in a more advanced negotiation process for Repar in Paraná, which has drawn the attention of companies such as Raízen (a joint venture between Shell and the energy and logistics conglomerate Cosan) and Ultrapar, owner of the Ipiranga network.
Union Requests To Participate In Process Against Petrobras’ Sale Of Refineries
The Union requested Minister Luiz Edson Fachin to allow participation in the process where Congress asks the STF to prohibit Petrobras from selling refineries without bidding.
In a petition filed on Friday, the AGU requested to be admitted as amicus curiae, a third party not directly involved in the process, but who can submit petitions and provide information.
On Thursday, Fachin released the process for judgment by the Virtual Plenary. The discussion will begin on the 18th and will continue until the 25th.
