In the request that will be judged by the STF, Congress argues that the eventual sale of Petrobras refineries would go against a previous decision of the court itself in 2019
The Plenary of the Federal Supreme Court (STF) is due to judge, as of next Friday, an injunction requested in July by Congress to prevent the sale by Petrobras of its refineries, with the petition citing the Bahia refining units (RLAM) and do Paraná (Repar). According to the STF, the judgment will take place in the virtual plenary, extending until September 25, and should have the participation of 11 ministers. At the end of July, the Federal Audit Court (TCU) issued a favorable opinion on the continuation of the sale process of Petrobras' refineries.
The expectation is that eight Petrobras refineries will be sold by next year, according to the agreement with Cade. Together, the units have 1,1 million daily oil processing capacity, around 50% of the country's refining park.

Petrobras' decision to sell part of its refining assets is in line with national energy policy and does not go against the STF's decision on privatizations, defended the ministries of Economy and Mines and Energy in a joint note earlier.
The first refinery to go on the market, Rlam, from Bahia, is in exclusive negotiation with the Mubadala fund, from Abu Dhabi. In addition, Petrobras is also in the process of more advanced negotiations for Repar, in Paraná, which attracted the attention of companies such as Raízen (a joint venture between Shell and the energy and logistics conglomerate Cosan) and Ultrapar, owner of Rede Ipiranga.
Union asks to participate in lawsuit against sale of refineries by Petrobras
The Union asked Minister Luiz Edson Fachin to participate in the process in which Congress asks the STF to prohibit Petrobras from selling refineries without bidding.
In a petition on Friday, the AGU asks to be admitted as amicus curiae, a third party not directly involved in the process, but who can submit petitions and provide information.
On Thursday, Fachin released the process for trial by the Virtual Plenary. The discussion will start on the 18th and go until the 25th.
