Emergency Care Did Not Prevent the Death
According to information from the Public Safety Secretariat, the incident at the Lapa Sports Center, also known as Pelezão, prompted the activation of metropolitan civil guards.
Upon arrival, they found a team from the Mobile Emergency Care Service (Samu) performing resuscitation attempts on the child.
Despite medical efforts, the victim did not survive. The death was confirmed at the scene, which underscored the need for a detailed investigation into the circumstances of the child’s drowning in São Paulo.
Case Treated as Involuntary Manslaughter Due to Negligence
Given the seriousness of the incident, the police authority classified the case as involuntary manslaughter when there is no intention to kill in the form of negligence due to improper omission.
The legislation applies this legal classification when there is a legal duty to act to prevent the outcome, but the expected action does not occur.
The Civil Police investigation seeks to identify whether those responsible for the management of the facility or for supervising the public pool failed to adhere to basic safety protocols, especially in a location frequented by children.
Forensics Will Investigate the Circumstances of the Drowning
To clarify the dynamics of the death in the public pool, the Civil Police requested forensic examinations from the Criminalistics Institute (IC) and the Medical Legal Institute (IML).
The analyses should indicate factors such as submersion time, pool conditions, and any structural or operational failures.
Investigators consider these reports essential to determine whether adequate prevention measures or rapid response could have prevented the drowning.
91st Precinct Takes Over the Investigation of the Case
The 91st Police District (Ceasa) registered the occurrence and is officially conducting the inquiry.
From now on, investigators will interview witnesses, staff, and those responsible for the Lapa Sports Center.
Additionally, investigators may review security camera footage and internal records of the public space.
The investigation aims to verify whether trained professionals were present to monitor the pool and whether the teams called for assistance in a timely manner.
Safety in Public Pools Returns to Debate
The drowning of a child in São Paulo reignites the debate about how public authorities ensure safety in public pools.
Experts warn that these locations require constant vigilance, especially during peak hours.
Experts point out measures such as the presence of trained lifeguards, clear signage, access control, and well-defined emergency protocols as fundamental to reducing risks and preventing similar tragedies.
Investigation Seeks Responsibilities and Prevention of New Cases
As the Civil Police investigation progresses, family members await answers regarding what led to the child’s death.
Thus, the inquiry should indicate any administrative or criminal responsibilities related to negligence due to omission.
At the same time, the case reinforces the importance of stringent oversight in public recreational spaces.
The investigation not only seeks to clarify what happened but also to help correct failures and prevent new incidents of death in public pools.
