The ANP – National Agency of Petroleum Conducted a Total of 18,955 Inspections in the National Fuel Market in 2022.
This data showed an increase of 6.3% compared to 2021. The numbers from the National Agency of Petroleum are in the Supply Inspection Bulletin – Balance 2022, communicated by the institution on Wednesday (15).
Within the report, the National Agency of Petroleum presented the distribution of inspection operations by geographic region, federation unit and economic sector, with information on the reasons for the infraction, quantity of products intercepted and seized, partnerships with other agencies, and complaints received.

The inspection actions resulted in 3,844 infraction notices, mainly due to: non-compliance with ANP regulations (20.5% of total infractions); loss of mandatory equipment or non-compliance with legislation (20.4%); sale or storage of products outside agency specifications (13.9%); failure to present financing documentation (8.4%); and failure to provide information to consumers (7.6%).

There were also 669 injunction notifications throughout the year, which are precautionary measures the agency takes to protect consumers, for example, to prevent the sale of products that do not meet specifications or in quantities different from those recorded. According to Law 9,847/99, once the ANP determines that the reasons for interception have ceased, it will carry out the interception without prejudice to the administrative procedure and without penalty.
Agency Inspection Includes Fines and Even Service Cancellation
Businesses cited by the ANP will be subject to the penalties provided by law, including fines ranging from R$ 5,000 to R$ 5 million. Penalties are only applied after administrative proceedings, during which economic agents have the right to broad defense and contestation under the law.
The resale section, including fuels and LPG (cooking gas), which serves sales establishments without deviations to consumers, is the one that receives the most inspection actions from the ANP. Gas stations totaled 13,977, and LPG concessionaires, 2,855.
Other actions take place at concessionaires (automotive fuels, aviation kerosene, LPG, solvents, and bitumen), producers of oil derivatives and biofuels, importers, terminals, filling stations, and more than 20 types of agents, as well as institutions not accredited by the ANP but not functioning properly.
In addition to routine inspections, the agency works with various public agencies. In 2022, there will be 280 joint operations and campaigns in 25 states, covering approximately 211 cities. In these actions, it was possible to inspect 1,641 economic entities, apply 282 infraction notices, and 106 interdictions. Partner agencies include Public Prosecutors, Police, Public Finances, Consumer Protection Agencies, and Metrology.
In 2022, there were 17,091 complaints from economic entities in the supply sector, of which 16,298 had complete information, involving 9,066 institutions. Of these economic agents, 8,230 (91%) complaints were analyzed and addressed by the ANP, while the remaining 836 (9%) were in the analysis and planning phase.
