The Reduction Of Energy Tariffs Approved By Aneel Provides For The Reimbursement Of Taxes Paid In Excess By Consumers In The Past
On last Tuesday (the 12th), a decrease of up to 5.26% in the energy tariffs for ten Brazilian distributors, located in different regions of the country, was approved by the National Electric Energy Agency (Aneel).
The reduction of tariffs was carried out to provide for the reimbursement of taxes paid in excess by energy consumers in the past. The reimbursement was mandated by law, approved and sanctioned in June, as an attempt by lawmakers and the government to mitigate the impacts caused by increases in the electricity bill during an election year.
This same law, which authorized the reimbursement of the taxes, also obliged Aneel to establish discounts on the annual tariff adjustments of energy distributors, starting from June of this year, and to conduct an extraordinary review if they had already undergone the adjustment process in 2022.

In this regard, last Tuesday, during the board meeting, Aneel approved tariff reductions for the following distributors:
Enel RJ (from the state of Rio de Janeiro): reduction of 4.22%;
CPFL Paulista (part of the state of São Paulo): discount of 2.44%;
Energia Borborema (from Paraíba): average decrease of 5.26%, considering all types of consumers (both high and low voltage);
CPFL Santa Cruz (part of the states of São Paulo, Minas Gerais, and Paraná): reduction of 2.32%;
Enel CE (from Ceará): decrease of 3.01%;
Sulgipe (from Sergipe): decrease of 4.88%;
Energisa Sergipe (Sergipe): discount of 4.47%;
Neoenergia Coelba (from Bahia): decrease of 0.50%;
Neoenergia Pernambuco – Celpe (Pernambuco): reduction of 4.07%;
Neoenergia Cosern (Rio Grande do Norte): decrease of 1.54%.
Such reductions started to be applied last Wednesday (the 13th), affecting the current tariffs. It is worth recalling that the reductions announced on Tuesday by Aneel aim to mitigate the effects of the increases communicated earlier this year for these ten distributors.
The increases in question, applied to the electricity tariffs of the ten distributors, ranged from 9.72% to 24.85%, becoming effective between February and May of this year.
Four More Distributors Were Supposed To Go Through The Tariff Review But Were Excluded From The Process
Another four electric utility distributors were also supposed to reduce their tariffs last Tuesday; however, their processes were removed from the agenda.
This occurred because Light, a utility operating in Rio de Janeiro, and Equatorial Alagoas obtained court orders that interrupted the revisions. Aneel intends to change these decisions.
On the other hand, the processes of Energisa Mato Grosso and Energisa Mato Grosso do Sul were postponed, as the tax credits have not yet been approved by the Federal Revenue Service.
Enel Rio Appeals Against The Reduction Of Its Energy Tariff
As previously mentioned, Aneel approved an average reduction of 4.22% in the energy tariff charged to Enel Rio consumers last Tuesday. However, the distributor requested that the process be removed from the agenda. Enel argued that the revision would harm the company’s revenue, making the economic-financial sustainability of the utility more difficult.
Aneel’s directors, however, did not heed the company’s request, justifying that the reimbursement of taxes paid in excess by consumers is mandated by law, and that the agency is only responsible for calculating the percentages.
