ANP Decision Expands Temporary Restriction on Biofuel Sales Among Distributors After Identifying Irregularities, Atypical Operations, and Possible Bionotes, Focusing on Oversight, Competition, and Integrity of the Regulated Market.

The ANP decided to extend the suspension of biofuel sales among distributors for another 180 days, aiming to contain irregularities, combat circular operations, and prevent the issuance of bionotes in the regulated market. According to an article published by Agência iNFRA on Monday (29), the decision was made unanimously during a special meeting of the board, reinforcing the regulator’s stance against practices that threaten competition and the national biofuels policy.

Regulatory Context of the ANP and Biofuel Sales

The measure, which had been in effect since May 1, 2025, was set to expire at the end of July but was maintained after technical analyses indicated atypical marketing patterns, even in a segment that represents only 4.5% of the market, equivalent to 384 thousand cubic meters in 2024. Despite the low volume, the identified risks led the ANP to choose to continue the restriction, prioritizing the integrity of the sector.

The ANP (National Agency of Petroleum, Natural Gas, and Biofuels) acts as the main regulatory body of the Brazilian energy sector, being responsible for regulating, supervising, and curbing irregular practices. In the case of biofuel sales among distributors, the regulator began observing behaviors that deviated from traditional operational logic.

In this context, the extension of the suspension is not just a punitive action but a preventive strategy. Furthermore, the decision reinforces the ANP’s institutional commitment to transparency, legal certainty, and a balanced competitive environment, which are fundamental pillars for attracting investments in the sector.

Irregularities Identified in Operations Between Distributors

During data analysis, the ANP identified relevant irregularities, particularly related to circular operations. These operations involve a restricted group of distributors that repeatedly alternated their roles as buyer and seller of biofuels, creating an artificial flow of commercialization.

Furthermore, cases were detected in which distributors sold significant volumes of biofuels without presenting compatible purchase records from producers. Although they claimed operational surpluses, the justifications were insufficient to explain the traded volumes.

These irregularities, although concentrated in a fraction of the market, compromise traceability, distort prices, and affect competition, justifying the strong action of the ANP.

Bionotes and Systemic Risks to the Biofuel Market

One of the central points of the decision was the identification of possible bionotes, characterized as invoices linked to non-existent biofuel purchase or sale operations. This type of practice, according to the ANP, can be used to simulate backing, inflate commercialized volumes, and mask tax fraud.

Consequently, the circulation of these possible bionotes represents a systemic risk, as they can weaken control mechanisms, harm public policies, and compromise the sector’s credibility. For this reason, maintaining the suspension of biofuel sales among distributors is seen as essential to interrupt this type of distortion.

The irregularities identified by the ANP are not limited to formal aspects. They directly impact the competitive environment, favoring agents that operate outside the rules and penalizing those who fully comply with regulations.

Director Symone Araújo highlighted that previous investigations have already resulted in the revocation of authorizations from producers unable to justify imported methanol volumes. This history, she said, underscores the high risk of diversion to illegal markets, with potential economic and social consequences.

Thus, the ANP’s actions seek to protect the market, ensuring that the sale of biofuels occurs in a regular, traceable manner that aligns with current regulations.

ANP Technical Evaluation and Next Steps

With the extension of the suspension, the Distribution and Logistics Superintendence (SDL) of the ANP was tasked with assessing the impacts of the measure and presenting a conclusive proposal for the definitive mitigation of irregularities.

Among the points to be analyzed are possible improvements in authorization criteria, additional requirements for proof of backing, and strengthening of monitoring and inspection systems.

Meanwhile, the ANP will continue to monitor the market and collect data to support future decisions. This technical process, in addition to being necessary, contributes to greater regulatory predictability, a decisive factor for planning by distributors and producers.

Relevance of the Measure for National Biofuels Policy

The Brazilian biofuels policy is strategic for energy transition, emission reduction, and compliance with environmental commitments. Any distortion, such as irregularities, circular operations, or bionotes, weakens these objectives.
