The Federal Government Regulated This Friday, April 29, the “Refis do Simples,” Which Allows Installment Payments of Debts of Small Businesses
After successive extensions, the government regulated on the 29th the “Refis do Simples,” a program that will allow the installment of debts of micro and small businesses and individual microentrepreneurs (MEI). Additionally, the Federal Revenue Service published in the Official Gazette of the Union (DOU) a normative instruction that regulates the Debt Payment Rescheduling Program within the scope of Simples Nacional (Relp). This program will benefit approximately 600 thousand small businesses.
The expectation of the Tax Authority, the country’s agency that controls tax payments, is that around R$ 8 billion will be parcelled by approximately 400 thousand companies, microenterprises, and small businesses. On the other hand, the National Treasury Attorney’s Office (PGFN) estimates that about 256 thousand companies will negotiate debts that could reach R$ 16.2 billion. To offset the profit deficit that the government will have with the regulation of the program, the government published on Wednesday, the 27th, a provisional measure that increases the CSLL, Social Contribution on Net Profit, paid by banks, from 20% to 21%.
The deadline for enrollment started this Thursday, the 28th, and will last until May 31 of this year. The debts that may be included under Simples are those that have, according to Simples assessment, maturity until February of this year 2022. Similarly, debts of the same type may also be included. The installment can be made in up to 180 monthly payments, with a reduction of up to 90% in fines and interest, depending on the situation.
The purpose of Relp is to provide microenterprises, small businesses, and enterprises with better conditions to face the economic effects arising from the Covid-19 pandemic, allowing them to remain compliant, as stated in the note released on the broadcast.com.br website.

FPE Celebrates New Regulation by the Government
The Parliamentary Front for Entrepreneurship (FPE) celebrates the regulation of the Refis do Simples program. According to them, the government made a decision that comes after a long wait that micro and small entrepreneurs had to endure. Although the start of the new measure has been widely postponed, it has initiated the regularization of more than 650 thousand business owners and small businesses who were eager to restart their operations after the hard two-year crisis imposed by the pandemic. This data was highlighted by the general coordinator of the Front, Marco Bertaiolli (PSD-SP). Marco also emphasizes that the opening of enrollments for the program ends a tedious effort to ensure the full effectiveness of Simples. He states that since December 2021, the FPE has been working to regularize the Refis do Simples, approved by the majority of Congress members.
How to Join the Program
As informed by the website Broadcast, to participate in the program, it is necessary to access the e-CAC portal on the Federal Revenue Service website, gov.br/receitafederal, or the Simples Nacional portal, gov.br/receitafederal/simples. To add debts that are being paid or under administrative processing, the taxpayer must withdraw from the installment or process.
Furthermore, the difference in debt related to social security contributions may also be parcelled in up to 60 monthly payments, however, the installments cannot be less than R$ 300 for micro and small businesses, and for individual microentrepreneurs, they cannot be less than R$ 50. Fines for non-compliance with obligations and debts of companies with declared bankruptcy are not included in Simples. The approval of the request for inclusion in the program is conditioned to the payment of the first installment, except for those who do not pay the full entry amounts by the eighth month of joining Relp. Those will have their enrollment canceled. For taxpayers who enter on April 29, 2022, the first installment will be due on the same day.
