The Federal Regional Court of the 1st Region (TRF1) upheld its decision to nullify traffic fines imposed due to signage failures on BR-324, between Feira de Santana and Salvador, over a period of 17 days. The ruling declared fines for signage failures, generally offenses for speeding, recorded above 80 km/h but within the limit of 100 km/h, due to the lack of signage informing the presence of speed cameras. According to arguments from the Federal Highway Police (PRF), the speed cameras were used legally and regularly, complying with the principles of morality and publicity. However, the appointed Federal Judge, Wilton Sobrinho da Silva, rapporteur of the case, stated that the Brazilian Traffic Code (CTB) requires that signage be visible and properly communicated to drivers before penalties are imposed.

The judge emphasizes that monitoring could only be carried out after the proper installation and communication of detection devices. He also points out that the lack of information undermines drivers’ right to extensive defense.

During the 17 days following the installation of speed cameras on BR-324, 1,590 fines for signage failures were recorded, which, according to the Justice system, would indicate a repressive nature to the action, going against the spirit of the Brazilian Traffic Code. The collegiate of the TRF1 denied the PRF’s appeal in light of this situation and upheld the nullified traffic fines during the analyzed period.
