Know When Errors in Dealerships or Shops Can Void Your Car Warranty and Leave You Without Factory Coverage. Understand Your Rights and Avoid Losses.

Buying a new car is a significant investment, and the factory warranty is one of the greatest protections consumers have against unexpected defects. However, this protection is not automatic or unlimited: it is conditional on meeting requirements outlined in the owner’s manual, mainly the completion of mandatory maintenance.

Many drivers are unaware that errors made during maintenance — whether at the dealership or independent shops can void the warranty either partially or completely. Understanding these rules is essential to avoid being caught off guard and losing coverage in the event of a defect.

What the Law Says About Mandatory Maintenance and Warranty

The Consumer Protection Code (CPC) does not contain a specific article about maintenance at dealerships, but it establishes important principles regarding warranties and prohibits abusive practices, such as tying sales (art. 39, item I). This means that the manufacturer cannot require the customer to perform maintenance exclusively at authorized networks as a condition for maintaining the car warranty.

On the other hand, the manufacturer can require the owner to meet the maintenance deadlines and mileage scheduled in the manual and use original or approved equivalent parts. Otherwise, if a defect arises directly related to a lack of maintenance or the use of unsuitable components, the warranty may be denied.

In summary: you can have maintenance done at independent shops, as long as you follow the manufacturer’s technical recommendations and keep invoices as proof. If there is a problem not related to maintenance, the warranty should be upheld.

Errors at Dealerships: When the Problem Begins at the Official Place

It is a mistake to think that losing the warranty only happens at independent shops. Dealerships can also make mistakes that harm the customer. Some examples:

  • Late or mileage-out-of-bounds maintenance: if the dealership itself delays delivering the serviced car, it may open the door for a denial of coverage.
  • Unapproved parallel parts: there are cases where unapproved parts are used to cut costs, compromising the integrity of the vehicle.
  • Incomplete or poorly executed services: the lack of records in the manufacturer’s system may lead to claims of “maintenance not performed.”

In these situations, the consumer should demand immediate correction and keep all receipts, as the dealership’s errors cannot be transferred to the customer.

Independent Shops: Rights and Limits for the Consumer

It is permitted to have maintenance done outside the dealership, but there are essential precautions:

  • Strictly follow the manufacturer’s manual, respecting the mileage or time intervals.
  • Use original or approved parts, with invoices proving their origin.
  • Document all services performed, attaching reports, work orders, and maintenance records.

Without these precautions, the risk of losing the warranty is high. This is because the manufacturer can claim that a defect was the result of inadequate maintenance.

Situations in Which the Warranty Can Be Voided

  • Failure to perform maintenance within the timeframe established by the manufacturer.
  • Unauthorized mechanical or electronic modifications, such as power chips.
  • Use of parallel parts or fluids outside of the manual’s specifications.
  • Misuse or negligence by the driver, such as driving without oil changes.

These cases open legal grounds for the manufacturer to refuse coverage, either partially or fully.

Situations in Which the Warranty Cannot Be Voided

  • Maintenance performed at an independent shop following all specifications of the manual and with original parts.
  • Manufacturing defects that are not related to the maintenance performed.
  • Failures caused by the dealership’s error or a factory-installed part defect.

The manufacturer needs to prove that the problem was caused by incorrect maintenance. Without this direct relationship, the warranty should be maintained.

How the Driver Can Protect Themselves

  • Keep all invoices and work orders from maintenance.
  • Confirm that the dealership registered the services in the manufacturer’s system.
  • Request that replaced parts be returned for inspection.
  • Carefully read the owner’s manual to know what the consumer’s obligations are.
  • If there is an undue denial of the warranty, the driver can appeal to the Consumer Protection Agency or even to the courts.

Mandatory maintenance should not be viewed as bureaucracy, but rather as a technical insurance that guarantees the car’s durability and protects the driver’s wallet. However, failures in the process — both in dealerships and independent shops — can open gaps for warranty loss.

Knowing your rights, demanding transparency, and keeping organized documentation is the best way to ensure that factory coverage is respected in any situation.
