The New Law Could Cause Big Problems for Uber, 99 Drivers, and Delivery Riders, Putting Their Driver’s License and Therefore Their Source of Income at Risk.
If you work as a driver for apps like 99, Uber, or as a delivery rider, it’s time to pay attention. A new law has come like a real bomb and could make you lose your driver’s license if you are not in compliance with the new rules.
The new law focuses on the acronym EAR (Earns Remunerated Activity) in the licensing document. According to the Traffic Portal, this identification is mandatory for anyone using a car as a source of income. The National Traffic Council (Contran) has already guaranteed a resolution that came into effect on January 2, 2023, establishing a fine of R$ 293.47 for those who need the EAR and are caught driving without this annotation.
What Does the New Law Say?
In summary, if you drive for a living, as a bus driver, truck driver, taxi driver, Uber driver, motorcycle taxi driver, or delivery rider, you need to have the EAR observation on your driver’s license. Only those who use the vehicle to facilitate work or travel between clients without being paid for the act of driving do not need this annotation.

The acronym EAR is not required, for example, for those who use their own truck to transport their production to sales points because the remuneration comes from the production, not from the act of driving. How to Regularize Your Situation?
To obtain the EAR designation, a psychological evaluation must be conducted and passed. Although the process varies from state to state, it is necessary to request the inclusion of the EAR at the Detran, paying the respective fees.
In São Paulo, for example, the psychological exam costs about R$ 130, and the fee for issuing the EAR and sending the driver’s license by mail is R$ 116.50. In total, this process can cost about R$ 285.96.
Consequences of the Infraction
Since Resolution 985 of Contran in January 2023, anyone caught engaging in remunerated activity without the EAR on their driver’s license faces fines of R$ 293.47 and seven points on their license. The fine is applied to the vehicle owner and can only be issued upon approach.
Benefits of the EAR
Despite the challenges, the EAR designation also brings benefits. Drivers with EAR have a limit of 40 points on their driver’s license, while for amateur drivers, the limit can vary from 40 to 20 points. Additionally, there is the possibility of taking a refresher course after reaching 30 points, helping to reset the score and avoid the suspension of the driver’s license.
