The new law focuses on the acronym EAR (Earns Remunerated Activity) in the licensing document. According to the Traffic Portal, this identification is mandatory for anyone using a car as a source of income. The National Traffic Council (Contran) has already guaranteed a resolution that came into effect on January 2, 2023, establishing a fine of R$ 293.47 for those who need the EAR and are caught driving without this annotation.
What Does the New Law Say?
In summary, if you drive for a living, as a bus driver, truck driver, taxi driver, Uber driver, motorcycle taxi driver, or delivery rider, you need to have the EAR observation on your driver’s license. Only those who use the vehicle to facilitate work or travel between clients without being paid for the act of driving do not need this annotation.

Drivers with EAR have a limit of 40 points on their driver’s license, while for amateur drivers, the limit can vary from 40 to 20 points.
