In The São Paulo City Council, App Motorcycles Move Forward With A Project That Imposes Strict Credentialing, Fines Ranging From R$ 4,000 To R$ 1.5 Million, A Toxicological Exam With A 90-Day Window, Mandatory Training, And A Ban On Rides On Fast Lanes And In The Expanded Center And Exclusive Bus Lanes.

On the night of December 4, 2025, the São Paulo City Council approved in the first vote the bill that regulates the app motorcycle services in the capital, with 29 votes in favor and 9 against, after discussions that began in the afternoon and ran until around 11:30 p.m. The text was drafted by the Subcommittee on Individual Passenger Transport by Motorcycle of the Council itself.

According to the G1 portal, the second vote is scheduled for Monday, December 8, and comes amid pressure from the deadline set by the São Paulo court, which ends on December 10, for Mayor Ricardo Nunes to publish the regulation decree. Meanwhile, the platforms 99 and Uber have already announced the resumption of the app motorcycle service in the city starting on December 11, relying on the new regulatory framework.

Approval In The 1st Vote And A Race Against The Clock In São Paulo

The regulatory bill for app motorcycles reaches the floor after a long legal battle between the city hall, companies, and class associations. The municipal administration had requested the suspension of the deadline to regulate the service, but the president of the Court of Justice denied the request, maintaining the December 10 deadline for publishing the rules.

While the Executive rushes to finalize the decree, the Legislative has accelerated the analysis of the Subcommittee’s text, which precisely defines how the service should operate, what requirements apply to drivers, companies, and vehicles, and what penalties will be imposed on those who violate the law.

Without compliance with these steps, app motorcycles will not be able to operate legally in the São Paulo capital.

Mandatory Credentialing For App Motorcycle Companies

The text stipulates that the intensive use of motorcycles for providing app motorcycle services will depend on the prior credentialing of the company, valid for one year. Without this active credentialing, the platform will not be able to intermediate rides in the city.

Companies will have to purchase Personal Accident Insurance (APP), ensuring coverage for users in case of accidents.

Additionally, they will need to present an initial plan for installing resting and parking points for motorcyclists, a measure aimed at reducing informality and improving waiting conditions on the streets.

The Executive Branch will have 60 days to analyze each credentialing request and may request additional documents whenever deemed necessary. Without the mayor’s approval, app motorcycles will be prevented from continuing to operate legally.

Driver Registration And New Barriers To Entry

To work with app motorcycles, the motorcyclist must meet a series of requirements. The project requires a minimum age of 21 years, a National Driver’s License in categories A or AB for at least two years, with a record of Exercise of Paid Activity (EAR) on the document.

The driver must provide the passenger with a helmet in good condition and a disposable cap, in addition to proving that they remain as a contributor to INSS, which may reinforce the social security protection of these workers.

Completion of a specialized course, no serious infractions in the past 12 months, and absence of convictions for crimes against women, sexual dignity, and other serious offenses will be mandatory.

One of the most striking points is the requirement for a toxicological exam with a minimum window of 90 days, which must be presented at the time of registration.

The registration will be free and must be completed before the driver’s registration on the platform, meaning that without this prior registration, the motorcyclist will not be able to accept rides for app motorcycles.

How The Motorcycles Used In The Service Must Be

The motorcycles used for passenger transport by app motorcycles will also have to comply with strict rules. Each vehicle must have a Vehicle Safety Certificate (CSV) and manufacture year not exceeding eight years, reducing the age of the fleet in circulation.

The text requires that the vehicle be registered in the rental category, necessitating the use of a red license plate, differentiating service motorcycles from privately used vehicles.

Motorcycles must also be equipped with rear and side grips for passenger support, protection devices for legs and engine, and kite-cutting antennas, aiming to reduce the risks of accidents, falls, and injuries caused by aerial lines.

In practice, the set of requirements is likely to increase the entry cost for those looking to work with app motorcycles, which may impact both the supply of drivers and the final price of rides to users.

Obligations Of Platforms And Data Sharing With The City Hall

The project stipulates that the platforms may only offer rides for app motorcycles with registered motorcyclists and certified vehicles. The app must clearly display the driver’s identification and the motorcycle certificate, allowing the passenger to verify the information before boarding.

Companies must provide the city hall with all data necessary for oversight, including limiting to only one vehicle per driver and maintaining a speed limiter in the app. It will also be mandatory to keep the APP insurance active throughout the operation.

Another central point is the detailed sharing of trip data with the public authority. The platforms will need to send information about origin, destination, route, waiting time, ratings, vehicle identification, accident records, and telemetry data about risky behaviors. The idea is to allow the city hall to monitor circulation patterns and safety of app motorcycles throughout the city.

Where App Motorcycles Will Be Prohibited From Circulating

The project establishes a list of areas and situations in which app motorcycles will not be able to circulate while transporting passengers.

Use of the service is prohibited in bus exclusive corridors and lanes, as well as in fast traffic roads, where the high speed increases the risk of serious accidents.

The restrictions extend to the mini-ring road in the expanded center area and the Maximum Truck Circulation Restriction Zone (ZMRC), increasing control over the flow of these vehicles in already saturated areas.

During adverse events, such as heavy rain, storms, floods, and low visibility periods, transporting passengers by registered motorcycles will also be prohibited.

The Executive may also define specific perimeters for operation and delimit pickup and drop-off points in terminals and public transport stations, which should reorganize the presence of app motorcycles in areas with a higher concentration of passengers.

Million-Dollar Fines And Punishments For Companies And Drivers

The penalties provided in the project range from warnings to cancellation of registration or credentialing, including fines, suspensions, and other administrative measures. For app motorcycle companies, fines start at R$ 4,000 and can reach R$ 1.5 million, depending on the severity of the violation.

These amounts may be charged daily if the infraction persists, creating a strong economic pressure mechanism for platforms to strictly adhere to the rules.

The text also provides that the fines will be adjusted annually based on the IPCA, preserving the deterrent power over time.

In practice, app motorcycles will now operate in an environment of intense oversight, where any noncompliance with registration, security, or data sharing can have a significant financial impact on companies and direct restrictions for drivers.

Judicial Pressure, City Hall Position, And Service Resumption

In late November, the platforms 99 and Uber announced that they will resume app motorcycle service in São Paulo on December 11, a date after the judicial deadline for regulation. The decision came in the wake of a Supreme Court ruling that deemed unconstitutional a state law that gave municipalities the power to authorize or prohibit the service.

The São Paulo City Hall, in turn, claims to be rigorously opposed to motorcycle taxi service in the city, classifying the modality as unregulated, dangerous, and associated with accidents and deaths of numerous passengers.

While the legal and technical areas of the Municipal Secretary of Urban Mobility and Transport analyze the issue, the pressure from users, companies, and judicial decisions pushes the administration towards a quick definition about the new rules for app motorcycles.

What May Change After The Second Vote

If the project is approved in the second vote and sanctioned, app motorcycles will operate under one of the most restrictive regulatory frameworks in the country, with strong control over who can drive, which motorcycles can operate, where the service will function, and how data will be shared with public authorities.

For users, the package of rules may mean more safety and traceability of rides, but also possible price increase and reduced supply, if some motorcyclists cannot meet all the registration requirements, toxicological exam, mandatory training, and vehicle regularization.

Trabalho nas ruas como entregador e vejo com frequência “motoboys” usando entorpecentes, para esses o exame toxicológico vai ser o principal meio de exclusão para essa plataforma de transporte.
