Approved by the Government, the new law 15.201 establishes payments of R$ 68 and R$ 75 for civil servants and experts who work on processes and assessments with overdue deadlines, aiming to accelerate the analysis of benefits.

The new law 15.201, of September 9, 2025, which creates the Benefits Management Program (PGB) within the National Institute of Social Security (INSS), has been officially published. The measure, approved by the Presidency of the Republic and detailed in a publication from the Government, establishes an extraordinary payment for civil servants and medical experts who work on analyses and assessments outside of regular hours to reduce the long waiting lines for benefits.

The impact of the initiative is direct for millions of Brazilians who are awaiting the conclusion of their processes, many with legal deadlines already exceeded. The central goal is to address the backlog of requests with more than 45 days of waiting, as well as medical assessments with scheduling longer than 30 days or with expired court orders. The measure will function as a paid task force to ease the social security system.

How Does the New INSS Bonus Work?

The new law establishes two distinct payments to compensate employees for extra work. The first, called Extraordinary Payment of the INSS Benefits Management Program (PEPGB-INSS), will be in the amount of R$ 68.00 per completed process. It is aimed at administrative staff who analyze retirement requests, pensions, and other aids that have already exceeded the legal deadline.

The second is the Extraordinary Payment of the Federal Medical Expert Benefits Management Program (PEPGB-PMF), set at R$ 75.00 per medical assessment or document analysis performed. This amount will be paid to experts who meet the excess demand. According to the text released by the Government, participation in the program is conditional on meeting regular performance targets, ensuring that ordinary service is not compromised by the task force.

It is essential to highlight that these amounts will not be incorporated into the salary or retirement of civil servants. According to Article 5 of the law, the bonuses are of an indemnifying and temporary nature, not serving as a calculation basis for other benefits or for social security contributions. The measure was designed as a targeted and emergency incentive to increase the operational capacity of the INSS.

Which Processes Are Priority and Who Can Participate?

The focus of the program, according to the new law, is the “bottlenecks” that most affect insured individuals. The highest priority will be given to administrative processes whose analysis period has exceeded 45 days or that have an expired judicial deadline. In the field of assessments, the target is the service units with a waiting line for scheduling longer than 30 days, places without regular service availability, and examinations ordered by the Court.

Moreover, the program will also cover the social evaluations necessary for the granting of the Continued Provision Benefit (BPC), one of those that suffers the most from delays. The document analysis performed by experts, as long as carried out on business days after 6 PM or on weekends, will also be compensated with the bonus. The intent is clear: to utilize all available working capacity to normalize the flow.

Civil servants holding positions in the Social Security Career and members of the Federal Medical Expert, Medical-Pericial Supervisor, and Medical Expert careers from Social Security can join the program. Participation is voluntary, but, as reinforced by the text approved by the Government, it will only be allowed after the civil servant reaches their regular productivity target, to prevent everyday work from being neglected.

Duration of the Program and Oversight Mechanisms

The new law establishes a validity period for the Benefits Management Program. The PGB will have an initial duration of 12 months, starting from the publication of the Provisional Measure that originated it (April 15, 2025). Article 8 provides for the possibility of a single extension, as long as the total duration does not exceed December 31, 2026, characterizing it as a time-limited solution.

To ensure transparency and monitor the effectiveness of the measure, a PGB Monitoring Committee was created. This group will be composed of representatives from the Ministry of Social Security, the Civil House, the Ministry of Management, and the INSS itself. The role of the committee, according to the publication from the Government, is to periodically evaluate the results, identify failures, and recommend improvements to work processes.

Additionally, the new law requires the Ministry of Social Security and the INSS to publish quarterly reports on their official websites. These documents must contain detailed information on the number of processes analyzed, assessments performed, savings achieved with reduced judicial payments, average response time, and the estimated social impact of the measure, allowing public oversight over the progress of the program.

Is the Bonus the Solution to the INSS Queue?

The new law represents a direct and pragmatic action by the government to solve a chronic problem affecting the lives of millions of Brazilians: the anguish of waiting for a social security right. By creating a clear financial incentive for extra productivity, the expectation is that the queue for benefits and assessments will begin to decrease significantly in the coming months. The structure of targets and oversight by a committee indicate a concern for the efficient execution of the program.

However, the measure is, by definition, palliative and temporary. Although it may relieve immediate pressure, it does not address the structural causes of queues, such as the lack of staff, outdated systems, and the increasing complexity of social security legislation. The success of the program will depend on the participation of civil servants and effective management of resources, but the definitive solution will require deeper reforms in the future.
