Many people dream of living the “American Dream“, but the route to get there is usually foggy. The biggest doubt revolves around the process to obtain the famous Green Card, the permanent residency authorization in the United States.

So today we will discuss two types of visas that can lead directly to the Green Card: the EB2-NIW and the EB3. The EB2-NIW, or National Interest Waiver, is a visa aimed at highly qualified professionals.

The EB3 is a visa that requires a job offer from an employer in the United States. Both have their own criteria and peculiarities, but the final destination is the same: the Green Card.

The EB2-NIW requires the candidate to prove their professional qualifications. In addition to a university degree, it is necessary to have at least five years of experience in their field. But it doesn’t stop there.

The candidate must present something that sets them apart in their field: a publication, a postgraduate degree, lectures given, among others. The idea is to show that you are a valuable asset to the United States.

EB3: Traditional Work Visa

The EB3 is simpler: you need a job offer in the United States. However, this visa can also have its peculiarities, such as EB3 “Unskilled”, which applies to workers without a requirement for higher qualifications.

It is very important to maintain your legal status while your process is ongoing. Many people get confused thinking that, once applied for the visa, they can stop studying or cease to maintain their tourist status. This is a mistake!

If something goes wrong in the Green Card process, you may find yourself in a delicate situation. Both visas take an average of 2 to 3 years to be processed. Therefore, it is essential to plan each step carefully.
