Bill Under Review in Congress Aims to Define Rules for App-Based Work, Address Social Security Contributions, and Establish a New Regulatory Framework for Approximately 2.2 Million Workers

The President of the Chamber of Deputies, Hugo Motta (Republicans-PB) announced that he intends to bring to the floor, by early April, the bill that regulates the work of app-based drivers and couriers in Brazil.

According to information released by the Chamber of Deputies in March, the proposal seeks to establish rules for an activity that brings together approximately 2.2 million workers in the country.

At the same time, as Motta explained, more time is needed to construct a politically viable text.

The goal is to ensure balance among the interests of digital platforms, workers, and the Brazilian regulatory system itself.

While negotiations continue, Congress is discussing relevant changes in the sector’s functioning.

Regulation of App-Based Work Advances in Congress

First of all, the legislative proposal seeks to organize the work model performed by drivers and app couriers.

In this context, the project attempts to establish minimum rules for an activity that has grown rapidly in Brazil over the last few years.

Furthermore, according to statements from the President of the Chamber recorded by the official portal of the Chamber of Deputies, the text needs to be adjusted to ensure political viability.

Therefore, negotiations continue to be conducted among the government, lawmakers, and representatives of the app-based transportation sector.

Meanwhile, Congress seeks to consolidate a regulatory framework capable of organizing the functioning of this market.

Debate on Minimum Fare for Rides Generated Divergence

Among the most debated points of the project was initially the definition of a minimum amount to be paid for rides or deliveries.

However, later on, this section was removed from the proposal.

According to Hugo Motta, there was an understanding among those involved that the minimum payment could make part of the rides on the platforms unviable.

According to the parliamentarian, about 25% of the rides have a value lower than R$ 8.

Therefore, according to the assessment presented, maintaining this requirement could compromise the functioning of some rides.

Thus, as Motta explained, the proposal came to exclude the obligation of a minimum amount for drivers.

Consequently, the project currently does not foresee a mandatory floor for rides conducted on platforms like Uber.

Social Security Contribution Also Integrates the Proposal

In addition to the debate on ride values, the project also addresses social protection for app-based drivers and couriers.

In this regard, the text establishes rules for collecting social security contributions.

According to the proposal presented in Congress, the contribution will have a rate of 5%.

This rate will apply to the minimum monthly salary threshold for low-income workers.

Thus, the goal is to provide access to benefits such as:

  • social security insurance
  • accident insurance
  • life insurance

Thus, the proposal seeks to ensure some level of social protection for workers operating on digital platforms.

Vote May Occur Between March and April

While negotiations continue, the Chamber of Deputies is working to conclude discussions in the coming weeks.

According to the President of the House, the expectation is that the final text will be voted on between the end of March and the beginning of April.

If the project is approved by Congress, a new regulatory framework for app-based work may be created in Brazil.

As a result, the country would have specific rules for the activity of drivers and couriers linked to digital platforms.
