Understand How the FGTS Dismissal Withdrawal Works, Who Is Entitled, Deadlines, Documents and How to Withdraw Using the Caixa App Without Leaving Home.
According to the website Meu Tudo, when a worker is dismissed without cause or resigns, they are entitled to the Dismissal Withdrawal of the Fundo de Garantia do Tempo de Serviço (FGTS). The FGTS is a financial reserve created to protect the worker in times of crisis, such as unemployment.
When the employment contract is terminated, the worker can access the balance of their FGTS account, which is one of the main ways to obtain funds during a professional transition period.
Who Is Entitled to the Dismissal Withdrawal?
The Dismissal Withdrawal is the traditional model for accessing the FGTS (Fundo de Garantia do Tempo de Serviço), and guarantees the worker the withdrawal of the accumulated balance in their linked account in specific cases provided by law.

This right is exclusive to those working under the CLT (Consolidação das Leis do Trabalho) regime and who fit certain labor situations.
Those entitled to the Dismissal Withdrawal include:
- Dismissal Without Cause: when the employer ends the contract without legal reason, the worker can withdraw the full amount of the FGTS.
- Termination of Fixed-Term Contract: at the end of the contract, the balance for the period can be withdrawn.
- Retirement: those who retire can withdraw the total balance in all linked FGTS accounts.
- Termination by Agreement: when the employer and employee mutually end the contract, the worker can withdraw up to 80% of the available amount.
- Serious Illness: in cases of severe illnesses of the worker or their dependents, withdrawal is authorized upon medical proof.
- Death of the Worker: dependents or legal heirs are entitled to the full withdrawal of the deposited amounts.
- Public Calamity: when officially declared, withdrawal can be partially released for residents of the affected region.
- Indirect Dismissal: when the worker requests termination due to serious employer failures, access to the FGTS is guaranteed by court decision.
Thus, the Dismissal Withdrawal serves as financial protection for the worker, allowing them access to the fund during moments of transition, need, or emergency.
