Judicial Ruling Acknowledges City Hall’s Failure and Grants Compensation of R$ 6,000 to Resident Whose Privacy Was Violated by Illegal Construction.

The Public Finance Court of Jacareí (SP) decided, in 2025, that the City of Jacareí and a neighbor must compensate a resident for moral damages.
The conviction occurred due to the construction of an illegal window that violated the woman’s right to privacy.
The case drew attention because it involved administrative omission and lack of public oversight.
Furthermore, Judge Samir Dancuart Omar set the compensation amount at R$ 6,000.

Ignored Complaints Initiated the Process

Between 2022 and 2024, the resident filed two formal complaints with the City Hall.
She reported that her neighbor built a window facing directly into her backyard, which affected her privacy.
Even after the complaints, the municipal administration did not take any action.
As a result, for over two years, she lived with litter in her backyard and a constant feeling of being watched.
Additionally, the delay by the government increased her discomfort and frustration.
In light of this neglect, the woman decided to seek justice to resolve the issue.

Ruling Reinforces the Duty of Oversight by City Halls

The rapporteur of the case, Judge Fausto Seabra, stated that the City had a legal obligation to act promptly.
According to him, “in light of a complaint about illegal construction, the City Hall must take immediate action.”
For this reason, the magistrate considered that the exposure of the resident exceeded mere daily annoyance.
The woman had her privacy compromised for an extended period, even after attempts to resolve the issue administratively.
Thus, the rapporteur highlighted the importance of more effective and transparent actions in municipal oversight.

Unanimous Vote Confirms Shared Responsibility

The judges Coimbra Schmidt and Eduardo Gouvêa fully supported the rapporteur’s vote.
The court published the ruling in October 2025, consolidating the understanding of civil responsibility of the government.
The panel recognized that the lack of action by the City contributed to the moral damage.
Consequently, both the offending neighbor and the City were held accountable for the damages caused.
The ruling served as an important example for future cases of neighborhood law.

Privacy and Dignity: Rights That Cannot Be Ignored

The episode demonstrated that the right to privacy is part of the dignity of the human person, an essential principle of the Federal Constitution.
Structures that allow direct view into private areas constitute serious violations of privacy.

These practices prevent conflicts and ensure harmonious coexistence among neighbors. Additionally, the case reinforces that dialogue and social responsibility are pillars of good community living.

In summary, the ruling shows that when privacy is violated, it must be protected and repaired in an exemplary manner.
