Incentive Package Approved In Last Ordinary Session On Thursday, 18 Guarantees JBS Reduction Of IPTU Calculation Base For One Year, Exemption For Nine Years, And ISS Benefit On Works, Conditioned To Job Generation And Investments Foreseen In The Municipal PRODES, Direct And Indirectly In The City.

In the last ordinary session of the year, held on Thursday, the 18th, the City Council approved a package of tax incentives that grants JBS in Campo Grande (MS) a reduction of the IPTU calculation base for one year and exemption from the tax for nine years on the property located on BR-060, where the company intends to expand its structure.

Furthermore, the project also exempts the company from paying ISSQN on civil construction works of the enterprise, within the rules of the Program of Incentives for Economic and Social Development, the PRODES, which supports the promise of generating employment, income, and development in the municipality.

What JBS Will Receive

According to the text approved by the Council, JBS will have reduction of the IPTU calculation base for one year and full exemption from the tax for nine years on the property located on BR-060.

The benefit directly impacts the area where the company plans to expand its food products industry and distribution center.

The package also includes exemption from ISSQN on civil construction works related to the project. In practice, this reduces the cost of the physical expansion of the unit, favoring investments in structure, production lines, and logistics.

According to the city hall, these incentives are part of a strategy to attract and consolidate large companies in the city, ensuring counter-offers in the form of job generation and movement of the local economy.

City Hall Conditions Incentives On Compliance With Targets

According to Mayor Adriane Lopes (PP), the benefits granted to JBS are outlined in the PRODES, a municipal program that offers tax and extraterritorial incentives to support projects for the installation, expansion, and modernization of companies.

The central justification is that the JBS project must generate employment, income, and development, both directly and indirectly.

The text makes it clear, however, that the incentives are not automatic and irreversible. In case of non-compliance with PRODES rules, the benefits may be canceled.

In this case, the city hall is authorized to collect all due tax credits, with the addition of interest for late payment, which serves as a form of pressure for the company to comply with the agreement.

Thus, the Executive’s message in approving the package is double-edged. On one hand, it signals support for the expansion of JBS and other considered strategic enterprises.

On the other hand, it reinforces that the maintenance of exemptions depends on the fulfillment of employment generation and investment targets promised.

Other Companies Also Received Benefits

The vote did not involve only JBS. In the same package, the Council authorized donations of public properties to other companies interested in investing in the city.

Among them are Tabita Althaus Brandão ME, Integração Empresarial Tomazelli, Cruz e Neres Ltda, and Dale Sorvetes Ltda, all under the rules of PRODES.

The transfers of ownership of properties to the companies ION Distribuidora Ltda and Blocobras Indústria e Comércio de Artefatos de Cimento Ltda were also approved, adjusting the legal situation of areas already designated for business activity.

The idea is to ensure that the properties remain linked to projects that effectively generate economic activity.

In the same session, the councilors also decided to revoke two previous laws, which had authorized donations of properties to companies that did not meet the commitments made with the city hall regarding job generation and promised investments.

The revocation reinforces the message that those who do not fulfill counter-offers may lose benefits.

What Is The PRODES And What Is The Program’s Objective

The Program of Incentives for Economic and Social Development (PRODES) continues the municipal policy of installation, expansion, and modernization of companies in the Capital, through donation of public properties with obligation and granting of tax incentives.

The main focus is the Municipal Business Poles, created specifically to receive productive enterprises.

PRODES was instituted by Municipal Complementary Law No. 418, of October 15, 2021, and regulated by Decree No. 15,081, of February 4, 2022.

The legislation establishes that the program aims to boost the economic, social, tourist, cultural, and technological development of the municipality, sustainably offering incentives for legal entities and individual entrepreneurs who meet the requirements and commit to investment and job generation targets.

In the case of JBS, the city hall uses this legal framework to justify the IPTU exemption for nine years and the ISS benefit on works, betting that the expansion of the food industry and distribution will strengthen the local economy and create new job opportunities.

É muita putaria…

Concordo em parte, pois a JBS não precisa de todos estes incentivos, além do mais as cláusulas deste acordão vai ficar pendentes para os próximos governantes que poderão não concordar com esta jogada e não poderá cobrar o comprimento dos mesmos. O certo seria trocar os incentivos fiscais por investimento em infraestrutura corporativas que traria benefícios a todos os cidadãos envolvidos.
