Mato Grosso do Sul Executive Branch Achieves Approval of Constitutional Amendment for Exploration of Waterway and Railway Transport Services in the State

The Legislature of the State of Mato Grosso do Sul Acquired New Victories During This Week, with the Approval in First Vote of the PEC That Grants the Exploration of Transportation Services by Railway and Aquatic Means Within the State Limits, Besides Other Projects.

During last Tuesday (28/06), the PEC (Proposed Constitutional Amendment) from the Executive Power to grant the exploration of transportation services by aquatic and railway means in Mato Grosso do Sul was approved in the first vote. Thus, the state authority will have more autonomy for the exploration of these services within the state’s territorial limits. In addition, a number of other bills were also approved that will contribute to the state government.

PEC from the Executive Power of Mato Grosso do Sul for the Exploration of Intermunicipal Transportation Services Within the State Limits is Approved This Tuesday

Aiming to contribute to greater autonomy for the state government to guarantee the exploration of transportation services, the Executive Power of Mato Grosso do Sul presented a new PEC for the sector, which was approved during this Tuesday in the first vote.

Thus, the proposal adds article 8A to the State Constitution, with the objective of expressing the state’s competence to explore, through authorization, concession, and permission, the state road, aquatic, and railway transportation services within the territory of the State.

The text presented by the Executive Power of the state of Mato Grosso do Sul for the approval of the PEC also sought to ensure the exploration of services between Brazilian ports and borders. To this end, the document was based on the analysis of art. 21 of the Federal Constitution, which states that it is the Union’s responsibility to “explore, directly or by means of authorization, concession or permission: the railway and aquatic transportation services between Brazilian ports and national borders, or that cross the State or Territory limits.”

Now, with the initial approval of the PEC for the exploration of these services, aiming to expand the relevance of the transportation sector in the state with new businesses, the text will proceed for distribution and analysis by the Constitution, Justice and Drafting Commission (CCJR) and will await final approval. 

Other Bills Were Approved in the State of Mato Grosso do Sul to Address Public Positions and Services, Besides the Transportation Sector in the Region

The approval in the first vote of the PEC that determines the state’s autonomy for the exploration of intermunicipal transportation services within the territory of the state of Mato Grosso do Sul was not the only one on this Tuesday. This is because, during the vote, other bills were advanced in the state.

Among them is Bill 150/2022, which modifies the current text and adds to State Law 3.344, dated December 22, 2006, which regulates the use and occupation of the right-of-way of the state highways in Mato Grosso do Sul.

Moreover, new bills, beyond the transportation sector, were approved in the first vote in the state. The main one is Bill 182/2022, which adds a provision to article 156 of Law 1.102 of October 10, 1990. This law is responsible for addressing the legal regime of civil public servants of the Executive Power, Autarchies, and Public Foundations of the State.

Finally, Bill 157/2022, authored by the Judiciary, which modifies article 104 of Law 3.310, dated December 14, 2006, was also approved this Tuesday. Thus, the state of Mato Grosso do Sul may gain new directions with the upcoming votes of the PEC and the bills.
