Launched in September last year, with the aim of expanding the Brazilian railway network with private investments, the Pro Trilhos program starts this year with 21 authorization contracts for the construction and operation of railways signed. The formalization between the Union and companies that requested the creation of their own railways under the new model appeared in the DOU.

Together, these projects accumulate about 6,839.69 km of new tracks to the national railway network, mainly to the rail networks in the states of Minas Gerais, Paraná, Espírito Santo, São Paulo, Maranhão, Santa Catarina, Pernambuco, Bahia, Mato Grosso do Sul, Piauí, Goiás, and Mato Grosso, as well as the Federal District. The expected investments for the construction of railways amount to R$ 102.3 billion.
So far, there are already 12 companies that have the necessary authorization from the Federal Government to operate, constructing and operating, with their own resources, railway terminals and railways in 13 states.

The granting through authorization is a procedure with less bureaucracy and faster than the traditional concession model. The proof of the speed of the new regime of the Pro Trilhos program is that the first proposals with authorizations were filed in September of last year with the MInfra.
MInfra Receives 76 Requests for the Construction and Operation of Railways
Nevertheless, since then, the 21 authorized projects for the Pro Trilhos program have undergone a careful process. The program included document verification and proposal detailing by the team of the National Secretariat of Land Transport (SNTT), analysis by the National Land Transportation Agency (ANTT), and evaluation of the project’s compliance with the national public policy of the sector and transport, again by the SNTT.
To date, MInfra has received 76 requests for the construction of railways under the Pro Trilhos program, totaling 19,000 kilometers of new private railways, covering 16 states with investments reaching R$ 224 billion.
The estimate is that 2.6 million direct and indirect job vacancies will be created, reducing CO2 emissions and transportation costs, along with updating the Brazilian railway network.
Pro Trilhos Program
The Railway Authorization Program, developed through Provisional Measure 1.065/2021, begins the granting by authorization for the sector, making the initiative in the railway market free.
Thus, the private sector can create and operate yards, branches, railway terminals, among others. The Legal Framework for Railways was approved by the National Congress on December 14 of last year and was sanctioned by President Jair Bolsonaro 10 days later. Thus, logistics operators and industrial carriers are free to request authorization for railway construction and operation.
