An Item Viewed As A Quick Solution For Personal Defense, But That Can Turn A Common Situation Into A Major Legal Problem If Used Improperly

Few people realize, but curiosity about pepper spray has grown so much in recent years that the product has ceased to be just a tactical tool of the police forces and has started to gain popularity as a supposed self-defense item among ordinary citizens. The question, however, is always the same: is buying pepper spray legal or illegal? This question has sparked heated debates, especially among women concerned about robberies, attempted assaults, and sexual crimes on the streets and public transport.

It all started when a follower asked on the channel ‘Don’t Fall For It’ if she could buy the spray online to carry in her purse or leave in her car “just for safety.” The question, which seems simple, opened the door to a topic much more complex than most imagine. After all, even though it can be found on large marketplaces, some quite well-known, the fact that a product is for sale online does not mean it is legal for civilians to acquire. And, precisely because of this, many people fall into a legal trap without realizing it.

Before understanding why pepper spray is not a common item, it is worth recalling how it arrived in Brazil. Originally, the equipment was introduced as a police tool, especially to control violent, drugged, altered individuals or those resisting arrest. As explained by the specialist in the original video, “the police realized that to subdue certain individuals, it was necessary to have a resource that temporarily neutralized the aggressor’s vision and respiratory capacity, allowing them to be handcuffed and restrained without extreme risk.”

The spray, when hitting the eyes and throat, causes intense burning, tearing, difficulty seeing, and a sensation of suffocation that is hard to bear. It is a mechanism of temporary incapacitation. However, this also makes it an extremely sensitive product, capable of generating severe side effects even in those who are not directly hit — especially in enclosed environments.

What Many People Don’t Know: Pepper Spray Is A Government-Controlled Product

Although the internet is full of ads offering pepper spray as an easy solution for personal defense, the product is controlled by the Army and security forces. Therefore, its use and purchase are restricted to police agents. This means that an ordinary citizen cannot acquire the equipment, even if they find it freely available on shopping sites.

This information, often ignored or unknown, creates an additional problem: many people believe that the simple fact of the spray being for sale indicates legality. But considering that online commerce is almost infinite and full of irregularities, it is common to find prohibited, stolen items, or those without an invoice available freely. And enforcement, as the specialist explained, is not simple — only reported cases undergo investigation.

Even so, the scenario becomes even more concerning when civilians use the spray in everyday situations. Improper use, especially in enclosed spaces, can lead to unpredictable consequences. In 2019, before the pandemic, a young man inside a nightclub in São Paulo got into a disagreement with a larger man and decided to use a pepper spray he carried in his pocket. One single spray was enough for chaos to ensue: doors had to be opened, the environment had to be evacuated, and no one could remain in the area due to the widespread burning caused by the substance.

If such a situation occurs in the presence of police, the civilian carrying the spray may be apprehended, interrogated, and legally held accountable for possessing and using equipment that should not be in the hands of an ordinary person. In addition to embarrassment, there is a real risk of criminal liability.

And What About Ginger Spray? It Is Legalized, But Can Be Just As Dangerous

Given the popularity of pepper spray and the ban on civilians, some Brazilian companies have started to sell an alternative: ginger spray. Unlike pepper spray, it is not a controlled product and can be purchased by anyone, as it does not contain substances classified as chemical weapons.

However, although legal, this does not mean it is safe or recommended. In situations of stress, fright, fights, or attempted robberies, a lack of emotional preparation can lead the person to miss the target, disperse the spray towards themselves, or create a commotion around them. Thus, the instrument that seemed like a self-defense solution can easily turn against the user.

This information was initially discussed in the video published on the channel, as explained by the presenter, who reinforced: “Even though it is legalized, ginger spray requires training and emotional control. Without this, the risk of the equipment harming you is greater than that of protecting you.”

Is It Worth Carrying A Defense Spray?

In light of all this, the answer is straightforward: it is not worth carrying pepper spray, because it is illegal for civilians and can generate serious problems. As for ginger spray, although legal, it is also not a completely safe choice. Self-defense depends on preparation, awareness, and training — not on instruments that can get out of control.
