Bill Under Consideration in the Chamber Proposes Heavy Fines and Suspension of Driver’s License for Drivers Who Make Dangerous Overtaking or Irresponsible Maneuvers
A new traffic law is causing concern among drivers. The bill under consideration in the House of Representatives proposes heavy fines and suspension of the driver’s license for up to 12 months for those caught making dangerous overtaking or irresponsible maneuvers. The penalty can be even stricter in case of recidivism, reaching two years of prohibition from driving on highways.
What Changes With the New Traffic Law?
The proposal, authored by Deputy Clodoaldo Magalhães (PV-PE), aims to amend the Brazilian Traffic Code, focusing on road safety. According to Bill 1405/24, any maneuver considered irresponsible, which endangers the integrity of people or the safety of the road, will be severely punished. This includes heavy fines and a suspension of the driver’s license for up to one year.
The bill defines “dangerous overtaking” as any overtaking performed in prohibited areas or in situations where the driver does not have adequate visibility conditions, potentially causing serious accidents. Those caught committing this infraction may be fined R$ 2,934.70 – equivalent to ten times the value of a very serious fine, which is currently R$ 293.47. Seven points will be applied to the driver’s license of the offending driver.

Recidivism and Doubled Penalty
For recidivist drivers, the new traffic law provides that the suspension of the driver’s license will be applied in double, that is, two years without being able to drive on highways or roads. The idea behind the measure is to toughen the rules to combat recklessness on the road and, thus, reduce the number of serious accidents in Brazil.
According to Deputy Magalhães, the main objective is to protect the lives of all road users. “The practice of overtaking in prohibited areas, at high speeds, or without proper caution, endangers not only the driver’s life but also the lives of all road users, including passengers of other vehicles and pedestrians who may be nearby,” the deputy told the Câmara Agency News.
Status of the New Traffic Law Bill
The bill still needs to be analyzed by two committees in the House of Representatives: the Committee on Transport and the Committee on Constitution, Justice, and Citizenship. If approved by both, it will proceed to a vote in the plenary of the Chamber and subsequently in the Federal Senate, before being sanctioned and officially becoming a new traffic law.
The expectation is that if approved, this measure will have a significant impact on Brazilian roads, especially in rural areas and on busy highways, where dangerous overtaking is more common. Drivers across the country need to stay alert, as with the approval of the bill, the heavy fine and suspension of driver’s license for one year will become a reality, which can change behavior on the road.
With increased enforcement and the rigidity of penalties, the new rule can bring more safety for drivers and passengers, but it also represents a challenge for those who are used to committing infractions such as overtaking in inappropriate locations.
