Electric bicycles with throttle are legal and represent a real alternative to motorcycles. Although purist cyclists may see this as unconventional, we need to have a broader view of the market.

The market offers varied options to meet the demands of different transport users in cities. Saying that bicycles that propel without pedaling are not bicycles is something to keep in mind.

The fact that a vehicle is legal does not mean we can disrespect the law as we wish. Unfortunately, we see this kind of disrespect for traffic regulations constantly in large cities today.

An electric bicycle with throttle is not considered a Pedelec or EPAC in Europe. The fact that it provides power regardless of pedaling excludes it from the group of pedal-assisted vehicles.

These bicycles typically offer nominal powers exceeding 250 W due to their configuration. They can reach a maximum speed of 45 km/h powered solely by the electric motor.

An electric bicycle with throttle is not technically a Speed Pedelec by standard definition. Speed Pedelecs provide power while you pedal, unlike those with only a throttle.

For legal purposes, a Speed Pedelec is considered a motorcycle by traffic authorities. The electric bicycle with throttle also receives the same legal classification as a motorcycle under the law.

Regulations classify these vehicles as two-wheeled mopeds in the technical category L1e-B. They must be registered and need formal certification to circulate on streets.

Operational Advantages Over Traditional Transport

The concept of efficiency is becoming more common in our society. The old saying that says “the bigger, the better” still prevails but is gradually changing.

An electric bicycle with throttle may not be the preferred choice of an ordinary cyclist. This profile generally prefers the traditional feel of pedaling, even with a motor to assist.

The model may be the ideal option for current motorcycle or moped users. These users typically want to further reduce their fixed and variable daily commuting costs.

An electric bicycle will require less maintenance than other motorized two-wheeled vehicles. Its components are cheaper, and wear and tear is minimal since the power is much lower.

The vehicle is comparable to a conventional electric bicycle in terms of mechanical wear. This represents a significant savings in money for daily commutes compared to combustion motorcycles.

The user can exercise during the trip if they wish to pedal voluntarily along the way. This is something impossible to do with a motorcycle, whether electric or combustion.

You can even pedal without the assistance of the motor if you feel inspired to do so. The electric bicycle with throttle provides that flexibility of hybrid use between physical exercise and transport.

An electric bicycle with throttle is much easier to use in daily practice. A motorcycle or moped will always be more difficult to maneuver than a lightweight bicycle.

The bicycle is much lighter and more compact than any motorcycle available on the market. It is an ideal option for commuting to work and bringing indoors.

Bringing the vehicle inside greatly facilitates recharging the battery during work hours. A motorcycle is more complicated in this sense and usually cannot enter enclosed spaces.

Bureaucratic Procedures and Requirements for Registration

The manufacturer must be duly registered with the Ministry of Industry to operate legally. The company needs to obtain an Initial Assessment Certificate issued by an authorized entity for that purpose.

The brand needs to acquire a Global Identification Code for its produced vehicles. It must also have a favorable Test Report from a duly accredited Technical Certification Service.

The brand needs a manufacturer’s authorization registration with the Ministry of Industry. An authorization request from the General Traffic Management is necessary to validate the process.

The company must have sufficient resources to issue technical sheets for sold vehicles. A Reduced Data Sheet registration is required for each certification sold to the Ministry.

A registration fee will be necessary to regularize the vehicle’s status. The owner must obtain a vehicle registration document which requires documentation such as the ITV certificate.

All of this may seem like a lot, but it is normal for a regular moped. For those used to riding only bicycles and pedaling, it may seem a bit complicated.

We strongly recommend that you seek a reputable manufacturer with a presence in the market. Established companies will facilitate all the necessary procedures for the regularization of your electric vehicle.

Be cautious if your purchase comes without restrictions and with an installed throttle. You will be required to register it to avoid legal issues with local traffic authorities.

Requirements for the Driver and Technical Exceptions

The driver needs to have a driver’s license to operate the vehicle on public roads. A car license is valid if we have three years or more of proven experience.

The user will need to obtain the required license if they do not possess the required car license. The minimum age established by law to obtain this specific documentation is 15 years.

Mandatory insurance is an essential requirement for legal circulation under these conditions. The driver must always wear an approved helmet, as regular bicycle helmets are not valid.

There are electric bicycles with throttle that technically function like a standard Pedelec. They have a motor limited to 250 kW of continuous power and provide assistance when pedaling.

The electric assistance is interrupted at 25 km/h in these specific bicycle models. They are certified as Pedelecs or EPACs and can be used legally as conventional bicycles.

These bicycles have a trigger or rotary throttle to provide extra power. The system supplies power regardless of whether we pedal or not, functioning autonomously while pedaling.

The manufacturer warns that the use of this throttle is restricted to private areas. Use in non-public places is entirely at our own risk.

Using the throttle on public roads may result in a fine from the competent authorities. Manufacturers limit these triggers or throttles to a maximum of 6 km/h for safety.

The device is legally considered only as a “walking aid” at that speed. Some models offer the option to remove the limiter, altering the original characteristics of the product.

No Brasil – pois ao que tudo indica, essa matéria mencionou e/ou se referiu especificamente as Leis Européias – uma Bicicleta Elétrica que possua acelerador, que tenha entre eixos de no máximo 1,30 metros, e largura até 0,70 metro, e motor até 1000 watts de potência e velocidade máxima de 32 km/h, é considerada portanto um AUTOPROPELIDO, e não sendo necessária habilitação ou ACC e nem emplacamento. Resolução 996 do Contran (Brasil).
